I• <br />A RESOLUTION <br />AUTHORIZING CONDEMNATION PROCEEDINGS TO <br />ACQUIRE EASEMENTS ACROSS A PORTION <br />OF PARCEL 144 ON CITY REAL PROPERTY TAX MAP 50 <br />WHEREAS, the City of Charlottesville, Virginia needs <br />to obtain permanent easements and rights-of-way to construct, <br />replace, maintain and repair a sanitary sewer line across a <br />portion of a lot identified as Parcel 144 on City Real <br />Property Tax Map 50, and to widen, reroute and maintain <br />a drainage channel across a portion of the same lot located <br />within the City limits off East High Street; and <br />WHEREAS, consent to the purchase of the property and <br />easements necessary for the project cannot be obtained; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />• City of Charlottesville, Virginia, that a public necessity <br />is hereby declared to exist for the acquisition of permanent <br />easements and rights-of-way across Parcel 144 on City Real <br />Property Tax Map 50 in order to proceed with sanitary sewer <br />and drainage improvement projects; and <br />�J <br />BE IT FURTHER RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the City Attorney be and <br />hereby is directed to institute condemnation proceedings <br />for the acquisition of the permanent easements and rights- <br />of-way across a portion of Parcel 144 on City Real Property <br />Tax Map 50 and to file the necessary documents with the <br />Circuit Court for the City of Charlottesville as provided <br />in §§15.1-898 and 15.1-899 of the Code of Virginia (1950), <br />as amended, and §§41 and 50.1 of the Charter of the City <br />of Charlottesville, Virginia. <br />Approved by Council <br />September 12, 1983 <br />C erc of Council <br />83-6-41 <br />
