U <br />J O I N T R E S O L U T I O N <br />WHEREAS, the Board of Supervisors of Albemarle County, <br />the City Council of the City of Charlottesville, the Board <br />of Directors of the Albemarle County Service Authority, and <br />the Board of Directors of the Rivanna Water and Sewer Authority <br />in January, 1983 adopted a Joint Resolution approving the <br />acquisition by Rivanna of property for the Buck Mountain raw <br />water supply; and <br />WHEREAS, the parties previously adopted criteria to be <br />applied in determining the area to be acquired in fee and <br />the area to be controlled by the acquisition of easements; <br />and <br />WHEREAS, the staff of the Rivanna Authority after <br />careful study of the affected areas, has recommended certain <br />changes in the adopted criteria, for reasons of economy, to <br />provide better watershed protection, or to accommodate <br />certain existing homeowners where such accommodation can be <br />made without impairing future water quality, and has submitted <br />a revised criteria for the acquisition of land and easements <br />for the proposed Buck Mountain water supply; and <br />• WHEREAS, a possibility exists that minor changes not <br />now contemplated may occur during property acquisition, the <br />Rivanna Authority requests that it be allowed to make such <br />changes as, in its sole discretion, it may determine to be <br />in the best interest of all parties to this Resolution; and <br />WHEREAS, maps have been prepared delineating the changes <br />proposed, have been shown to the parties to this Resolution, <br />and are now on file in the office of the Watershed Management <br />Official; and <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors <br />of Albemarle County, the City Council of the City of Charlottesville, <br />the Board of Directors of the Albemarle County Service <br />Authority, and the Board of Directors of the Rivanna Water <br />and Sewer Authority that: <br />(1) The revised criteria as shown on the "Conclusions <br />Regarding a Reservoir on Buck Mountain Creek as affirmed by <br />the Board of Supervisors and City Council", marked Exhibit <br />A, and the maps submitted marked Exhibit B-1 and Exhibit B-2 are <br />approved for use in the acquisition of land and easements <br />for the proposed Buck Mountain water supply. <br />(2) The Rivanna Water and Sewer Authority is authorized <br />to make minor changes in the areas to be acquired in fee or <br />• by easement when, in its sole discretion, it determines such <br />changes to be in the best interest of the parties to this <br />Resolution. <br />
