• <br />Ll <br />E X H I B I T A <br />CONCLUSIONS REGARDING A RESERVOIR ON BUCK MOUNTAIN CREEK AS <br />AFFIRMED BY THE BOARD OF SUPERVISORS AND CITY COUNCIL <br />1. Accept the recommendation of the Rivanna Water & Sewer <br />Authority Board of Directors that Buck Mountain Creek be <br />selected as future raw water supply source and that a dam be <br />built at the appropriate time at Site C which is identified <br />in a study by Camp Dresser & McKee, dated June, 1982 entitled <br />"Buck Mountain Feasibility Study Phase III Final Report, <br />Subsurface Investigation Site C." <br />2. A minimum buffer zone of 300 horizontal feet measured from <br />the normal pool level to be purchased using the fee simple <br />method except for slope additions to the buffer zone. <br />Permitted and prohibited land use practices in this future <br />pool area to be controlled by land use practices listed on <br />Attachment "A" dated August 4, 1982. This buffer zone to be <br />extended on a parcel by parcel basis based on one or more of <br />the following: <br />a. small remainder of parcel justifying acquisition of <br />complete parcel; <br />b. slope of land and length of slope beyond the take line <br />(these slope additions may be acquired by easement rather <br />than in fee simple); <br />c. wishes of the property owner; and <br />d. access to the property. <br />3. A 100 foot buffer zone on either side of minor tributary <br />streams to be acquired by easement. <br />4. In those cases where the land lying between a 300 foot buffer <br />measured from the normal pool level and a 300 foot buffer <br />measured from the 100 -year flood plain is not acquired in fee <br />simple pursuant to # 2 above, such land shall be acquired by <br />easement and controlled by permitted and prohibited land use <br />practices in the same manner as the tributary buffer area as <br />listed on Attachment "A" dated August 4, 1982. Additions to <br />these areas may be made based on the slope of land and the <br />length of slope beyond the easement line. These slope <br />additions are to be acquired by easement also. <br />5. In -stream sedimentation ponds to be placed on the four major <br />tributaries, including Burruss Branch, Piney Creek, Buck <br />Mountain Creek and Elk Run, as needed. <br />1 <br />
