• A RESOLUTION OPPOSING ANY LEGISLATIVE ATTEMPT TO ALLOW <br />DEVELOPERS TO CHOOSE PRIVATE CONTRACTORS TO REVIEW PLANS, <br />INSPECT CONSTRUCTION, AND CERTIFY COMPLETION OF PROJECTS <br />WHEREAS, the 1986 General Assembly passed SJR47 to provide for a joint <br />legislative study of the possibility of using private engineering firms in <br />the inspection of residential subdivision facilities and the advisability <br />of expanding the use by localities of private sector inspections for <br />residential development; <br />WHEREAS, under State law, localities at their option may use private <br />professional engineers or land surveyors for subdivision inspections; <br />WHEREAS, this Council is interested in this study, in order to assure <br />the safest, most efficient and economical construction and development <br />standards are carried out for the citizens and developers of Charlottesville. <br />THEREFORE, BE IT RESOLVED by the Council of the City of Charlottesville <br />that: <br />1. This Council strongly opposes any legislative attempt to mandate <br />use of private engineers and surveyors at the developers' option to perform <br />subdivision inspections and to mandate such use by local government of such <br />private professionals for inspections relative to residential development. <br />• 2. Such moves would constitute unwarranted intrusion into the detailed <br />affairs of local governments and deprive them of necessary control over the <br />enforcement of their own ordinances; raise serious questions of responsibility <br />and liability for such work, professional accountability, and payment for <br />services; and force a professional relationship that local governments may <br />not want, which in itself is unworkable. <br />3. Such legislative action is utterly unnecessary since most local <br />governments are discharging their review and inspections in a timely, <br />competent, and efficient manner. <br />4. Such legislative actions could adversly affect the vast majority <br />of local governments throughout the State of Virginia where the problem seems <br />to be limited to a few jurisdictions. <br />Approved by Council <br />October 20, 1986 <br />rk of Council <br />• 86-6-52 <br />
