RESOLUTION AMENDING SPECIAL USE PERMIT • GRANTED TO THE COVENANT SCHOOL ON NOVEMBER 3, 1986 TO ALLOW THEIR OPERATION AT THE MCINTIRE SCHOOL BUILDING AS A PERMANENT OCCUPANT/OWNER. WHEREAS, The Covenant School has requested an amendment to their special use permit, granted on May 20, 1985 and extended for two years on November 3, 1986, to allow the private school to operate at that location as a permanent occupant/owner; and WHEREAS, The Covenant School is the contract purchaser of Parcel "B• of the McIntire School Building and front property area; and WHEREAS, following a joint public hearing before this Council and the Planning Commission, duly advertised and held on April 14, 1987, this Council finds that such use will conform to the standards set forth in Section 31-220 of the City Code and to the criteria applicable to special permits generally under Chapter 31 of the City Code; now, therefore, BE IT RESOLVED by the Council of the City of • Charlottesville, Virginia that the special use permit which was granted May 20, 1985 and extended November 3, 1986 is hereby amended to allow the Covenant School to operate a private school at the McIntire School Building as a permanent occupant/owner. This property is further identified on City Real Property Tax Map #r45 as Parcel *7, having approximately 430 feet of frontage on the 250 Bypass, 570 feet of frontage on Birdwood Road, 590 feet of frontage on Edge Hill Road, 600 feet of frontage on Hillcrest Road and containing approxi- mately 315,500 square feet of land, or 7.24 acres. This amendment to the special use permit is conditioned upon the following: 1) Completion of the Phase II site plan for McIntire Village PUD, including the off-street parking areas and landscaping as well as some provision for dropping -off and picking up children by the June 1, 1987 deadline previously established. 2) That the maximum enrollment not exceed 150 students to avoid congestion associated with children being picked up or dropped off. 3) That an alternate bus or van service be provided once the enrollment of 150 is achieved. • Approved by Council May 4, 1987 erk of Council 87-6-25
