RESOLUTION GRANTING SPECIAL USE PERMIT <br />TO WESTWOOD LAND TRUST TO ALLOW <br />USE OF THE FACILITY AT 1414 and 1416 WESTWOOD ROAD <br />• FOR A DAY CARE CENTER. <br />WHEREAS, Thomas S. M. Brannock, on behalf of Westwood <br />Land Trust, has requested a special permit to allow use <br />of the existing school facility at 1414-1416 Westwood Road <br />as a day care center for up to 120 children, being further <br />identified on City Real Property Tax Map #44 as parcels <br />28.40, 28.41, 28.43 and 30.1 having collectively <br />approximately 227 feet of frontage on Westwood Road and <br />containing collectively 111,858 square feet of land or <br />2.57 acres. <br />WHEREAS, following a joint public hearing before City <br />Council and the Planning Commission, duly advertised and <br />held on June 14, 1988, and an additional public hearing <br />held before this Council on August 15, 1988 this Council <br />finds that such use will conform to the criteria applicable <br />to special permits generally under Chapter 31 of the City <br />Code; now, therefore <br />BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the special permit is hereby <br />granted to Westwood Land Trust to allow use of the existing <br />school facility at 1414-1416 Westwood Road as a day care <br />• center, for up to 120 children. <br />This special use permit is also subject to the following <br />conditions: <br />1. Administrative approval of a final detailed site <br />plan. <br />2. A grading and soil erosion/sediment control plan, <br />which shall include linear feet of piping, curbing and <br />silt fence to assist in determining a bond amount, will <br />have to be submitted for review and approval prior to final <br />site plan approval. <br />3. A total of 29 off street parking spaces are to <br />be provided. This may affect storm water management <br />provisions which should be detailed for review by the City <br />Engineer along with the storm water system calculations. <br />4. That the play areas and play fields be enclosed <br />with a fence to fill the gaps that are present. <br />5. That a railing be placed on any retaining walls <br />which are in excess of 36 inches high in accordance with <br />current building codes. <br />• 6. That any trees which are to be removed be replaced <br />with a comparable species on a one-to-one basis. <br />
