RESOLUTION AMENDING SPECIAL USE PERMIT GRANTED TO EURE COMMUNICATIONS, INC. ON OCTOBER 15, 1984 • TO ALLOW REPLACEMENT OF RADIO TOWER AT 1140 ROSE HILL DRIVE. WHEREAS, Michael Ludgate, on behalf of Eure Communications, Inc., has requested an amendment to the special use permit granted to Clay Media, Inc. (former owner of the property) on October 15, 1984 for the purpose of replacing the 70 foot radio tower at 1140 Rose Hill Drive with an 80 foot tower a distance of 90 feet from the property line and approximately 2 feet from the building on the site. This property is further identified on City Real Property Tax Map #44 as Parcel 30, having approximately 216.23 feet of frontage on Rose Hill Drive and containing approximately 103,187 square feet of land or 2.37 acres. WHEREAS, following a joint public hearing before this Council and the Planning Commission, duly advertised and held on July 12, 1988, this Council finds that such use will conform to the criteria applicable to special permits generally under Chapter 31 of the City Code; now, therefore BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the special permit granted • October 15, 1984 is hereby amended to allow Eure Communications, Inc. to replace the 70 foot radio transmission tower with an 80 foot tower a distance of 90 feet from the property line and approximately 2 feet from their building wall. This special use permit amendment is also subject to the following conditions: 1. Administrative approval of the site plan. 2. The removal of the existing transmission tower within 30 days of installation of the new 80 foot tower. 3. That the setback from the nearest property line be at least 80 feet but that the tower be permitted to be within 5 feet of the existing radio station building.
