• RESOLUTION <br />McINTIRE PARK <br />RECREATION AREA ACCESS FUNDS <br />CITY OF CHARLOTTESVILLE, VIRGINIA <br />WHEREAS, The McIntire Park is owned and is to be redeveloped <br />by the City of Charlottesville as a regional recreation facility <br />serving the residents of the City of Charlottesville and the <br />surrounding area; and <br />WHEREAS, the facility is in need of adequate access; and <br />WHEREAS, adequate access can be provided by the improvement <br />of the intersection of U.S. 250 Bypass and Rugby Avenue, the <br />construction of Rugby Road entrance into the park; and construction <br />of the park road to the Visitor's Center located in the central <br />part of the park; and <br />WHEREAS, all right-of-way and utility costs necessary for the <br />access road construction will be provided by the City of <br />Charlottesville at no cost to the state; and <br />WHEREAS, the procedure governing the allocation of recreational <br />access funds set forth in Virginia Code Section 33.1-223, as amended, <br />requires joint action by the Director of Conservation and Recreation <br />• and the Commonwealth Transportation Board; and <br />WHEREAS, a statement of policy agreed upon between the said <br />Director and Board approves the use of such funds for the construction <br />of access roads to publicly -owned recreational areas; and <br />WHEREAS, it appears to the Council of the City of Charlottesville <br />("the Council") that all requirements of the laws have been met <br />to permit the Director of Conservation and Recreation to designate <br />McIntire Park as a recreational facility and further permit the <br />Commonwealth Transportation Board to provide access funds for access <br />to this public recreation area in accordance with Virginia Code <br />Section 33.1-223, as amended; and <br />WHEREAS, the Council acknowledges that pursuant to the provisions <br />of Virginia Code Sections 33.1-223 and 33.1-62, as amended, the <br />access road shall be designated a "Virginia Byway" and recommends <br />the Commonwealth Transportation Board in cooperation with the Director <br />of Conservation and Recreation take 'the appropriate action to <br />implement this designation. Further the Council agrees, in keeping <br />with the intent of Virginia Code Section 33.1-63, to use its good <br />offices to reasonably protect the aesthetic and cultural value of <br />this road; <br />
