• RESOLUTION <br />APPROVING SPECIAL PERMIT FOR <br />REPUBLIC CAPITAL CORPORATION TO USE <br />THE STRUCTURE AT 1512 E. MARKET STREET <br />FOR AN ADULT DAY CARE CENTER <br />WHEREAS, Blake Hurt, President of Republic Capital <br />Corporation, has requested a special permit to allow use of the <br />structure and R-2 portion of the property at 1512 East Market <br />Street for an adult day care center, such property being further <br />identified on City Real Property Tax Map #56 as a portion of parcel <br />40.4, having approximately 154.6 feet of frontage on East Market <br />Street, and containing approximately 100,188 square feet of land, <br />or 2.3 acres; <br />WHEREAS, following a joint public hearing before this Council <br />and the Planning Commission, duly advertised and held on May 9, <br />1989, this Council finds that such use will conform to the criteria <br />applicable to special permits generally under Chapter 31 of the <br />City Code; now, therefore, <br />BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that the special permit is hereby granted to Republic <br />Capital Corporation to allow use of the structure and R-2 portion <br />• of the property at 1512 East Market Street for an adult day care <br />center, pursuant to City Code section 31-21. <br />This special permit is granted subject to the following <br />conditions: <br />1. Use of the day care center shall be limited to thirty <br />(30) elderly persons, exclusive of staff. <br />2. The applicant, contingent upon his gaining favorable <br />approval of the subject special use permit, has agreed <br />voluntarily to obtain approval of the Board of <br />Architectural Review for the adult day care project <br />located on approximately 2.3 acres at 1512 East Market <br />Street, and this permit is conditioned accordingly. <br />3. Regular hours of operation of the day care center shall <br />be 7:30 a.m. to 5:30 p.m. weekdays. Occasional night- <br />time and Saturday use shall be allowed not to exceed four <br />(4) times per month. Operation may also continue in <br />emergency situations. <br />4. Site plan review will be conducted pursuant to regular <br />code requirements with particular attention to off-site <br />parking, reasonable, but "not too high" screening, and <br />minimizing adverse impact on the neighborhood from <br />• lighting. <br />Approved by Council <br />June 5, 1989 <br />�lek< of Council 89-6-22 <br />
