0 A RESOLUTION AUTHORIZING EMINENT DOMAIN PROCEEDINGS TO ACQUIRE A PERMANENT EASEMENT AND RIGHT-OF-WAY ACROSS PROPERTY OWNED BY SOUTHERN VENTURES, INC. TO BE USED FOR PUBLIC PARK PURPOSES WHEREAS, the City of Charlottesville, Virginia needs to obtain a permanent easement and right-of-way across property identified as Parcel 144 on City Real Property Tax Map 50, which contains approximately 37,204 square feet, for use as public park land; and WHEREAS, bona fide efforts have been made to acquire the property by purchase from the owner, but the efforts have been ineffectual because of the inability to agree on the price or terms of the sale of the easement; and WHEREAS, the City has no recourse but to acquire the easement through the exercise of its power of eminent domain as authorized by the Code of Virginia and the Charter of the City of Charlottes- ville; • NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that a public necessity is hereby declared to exist for the acquisition of a permanent easement and right-of-way to property identified as Parcel 144 on City Real Property Tax Map 50, which contains approximately 37,204 square feet, for use as public park land, as more particularly described on the attached plat prepared by Kirk Hughes & Associates, dated July 1, 1991, in order to fulfill the public purpose of providing public parks within the City; and BE IT FURTHER RESOLVED by the Council of the City of Charlottesville, Virginia that the City Attorney is hereby authorized and directed to institute eminent domain proceedings to acquire the permanent easement and right-of-way to the property identified as Parcel 144 on City Real Property Tax Map 50, and to execute such instruments as may be necessary for the proceedings.
