RESOLUTION <br />• AMENDING THE SPECIAL USE PERMIT GRANTED <br />TO THE COVENANT SCHOOL TO ALLOW <br />EXPANSION OF SCHOOL ENROLLMENT <br />WHEREAS, the Covenant School, owner of property located at <br />1000 Birdwood Road, has requested an amendment to the special use <br />permit granted by City Council on August 14, 1987, originally <br />granted on May 20, 1985 and amended November 3, 1986 and May 4, <br />1987 (copies attached), which will allow enrollment of up to 450 <br />students; this property being further identified as Parcel 7 on <br />City Real Property Tax Map 45, having approximately 500 feet of <br />frontage on Route 250, and being approximately 7.2 acres; <br />WHEREAS, following a joint public hearing before this Council <br />and the Planning Commission, duly advertised and held on June 8, <br />1993, this Council finds that such use will conform to the criteria <br />applicable to special permits generally under Chapter 34 of the <br />City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that the special use permit originally granted on May 20, <br />1985, and amended November 3, 1986, May 4, 1987 and August 14, <br />1987, to the Covenant School is hereby amended to allow enrollment <br />of up to 450 students. <br />• The approval of this amendment to the special use permit is <br />conditioned upon the following: <br />1. Enrollment is limited to Kindergarten to Ninth Grade; <br />2. No outdoor interscholastic athletic activities shall be <br />permitted on site; <br />3. No daycare or afterschool care program shall be conducted <br />on site without further amendment of this special permit; <br />4. No regular evening programs shall be conducted at the <br />school other than occasional parent -teacher meetings, <br />social events or indoor athletic events, or similar <br />incidental uses. <br />5. The approved site plan, including landscaping and trees <br />to be added along Birdwood Road, must be completed; <br />6. A flashing school zone sign shall be installed in the <br />east bound lane of the Route 250 Bypass; and <br />7. The Planning Commission shall receive a copy of Covenant <br />School's report on compliance with the Americans with <br />Disabilities Act. <br />• BE IT FURTHER RESOLVED that the Covenant School is encouraged <br />to make every effort to meet its stated goals of 15% minority <br />representation in the student body, on the faculty and on their <br />board. <br />Approved by Council <br />July 6, 1993 C2hrk of City Council <br />
