Box 911 <br />Charlottesville, VA 22902 <br />Re: Adelphia's FCC Form 1215 - A La Carte Channel Offerings <br />Our File No. 24427.4 <br />Dear Clyde: <br />• The City of Charlottesville, Virginia ("City") has retained Mass & <br />Barnett, A Professional Association, to assist the City in reviewing FCC rate <br />regulation forms submitted by Multi -Channel T.V. Cable Company d/b/a Adelphia <br />Cable Communications ("Adelphia"). Adelphia has submitted to the City FCC <br />Forms 1200, 1205 and 1215. These forms were received by the City on <br />August 23, 1994. FCC regulations require that the City take action on <br />Adelphia's rate regulation filing within 30 days from the City's date of <br />receipt (See 47 C.F.R. § 76.933). -" <br />On August 25, 1994 I sent a letter via certified mail, return receipt <br />requested to Mr. John B. Glicksman, Assistant General Counsel for Adelphia, <br />placing Adelphia on notice that pursuant to 47 C.F.R. S 76.933 the time period <br />for the City's review of Adelphia's rate submission was extended for an <br />additional 90 days beyond the original 30 day time period. Therefore, the <br />City has until December 19, 1994 (120 days from the City's date of receipt) to <br />take action on Adelphia's FCC Form 1200 and 1205. With respect to Adelphia's <br />FCC Form 1215, the City has, pursuant to 47 C.F.R. § 76.986, 60 days to make <br />an initial decision addressing whether a collective offering of "a la carte" <br />channels will be treated as an unregulated service or a regulated tier.
