RESOLUTION APPROVING A SPECIAL USE PERMIT <br />FOR RELOCATION OF PET MOTEL ANIMAL SHELTER <br />AND ADDITION OF AN ANIMAL HOSPITAL AND <br />AND VETERINARIAN'S OFFICE ON 5TH STREET, S.W. <br />WHEREAS, the BMW Partnership, owner of property located on the <br />west side of 5th Street, SW at Moore's Creek, has requested a <br />special use permit to allow relocation of the Pet Motel animal <br />shelter from its existing location on 5th Street, SW, and the <br />addition of an animal hospital/veterinarian's office, to an <br />adjoining parcel approximately 200 feet southwest. This property <br />is further identified as Parcel 2 on City Real Property Tax Map <br />21B, having approximately 407 feet of frontage on 5th Street, SW, <br />and containing approximately 170,273 square feet of land or 3.9 <br />acres; <br />WHEREAS, following a joint public hearing before this Council <br />and the Planning Commission, duly advertised and held on June 11, <br />1996, this Council finds that such use will conform to the criteria <br />applicable to special permits generally under Chapter 34 of the <br />City Code; now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that a special use permit is hereby granted to BMW <br />Partnership to allow relocation of the Pet Motel animal shelter <br />• from its existing location on 5th Street, SW, and the addition of <br />an animal hospital/veterinarian's office, to an adjoining parcel <br />approximately 200 feet southwest. Approval of the special use <br />permit is conditioned upon the following: <br />(1) Administrative approval of the final site plan with all <br />necessary data shown on the final plan, including drainage data, <br />specific building height, tree canopy area and signs. <br />(2) Additional landscape to include junipers along the <br />frontage down to the toe of the slope and a minimum of 30 trees <br />along the Moore's Creek terraces as called for in the original <br />special permit for that work, and any other work called for in the <br />soil erosion plan. All improvements to the slope at Moore's Creek <br />and landscaping shall be completed prior to the issuance of any <br />occupancy permits. <br />(3) Completion of the specific improvements to address the <br />issues of sanitation, sound, odor,and waste management, including <br />but not limited to: <br />a. That drainage from interior pens go into the sanitary <br />sewer system. <br />b. That the building area where animals are housed be <br />enclosed with walls and window construction having a <br />sound transmission coefficient of at least 50 STC. <br />-1- <br />
