3. Each MEMBER unit of local government will, by resolution, name a SUBRECIPIENT to <br />carry out housing activities outlined in the Consolidated Plan within the locality which are <br />funded with HOME program funds (as differentiated from HOME CHDO funds). The <br />SUBRECIPIENT will enter into a contract with the COMMISSION to insure proper <br />implementation and management of the HOME program and funds. <br />1. The term of this Agreement shall cover a Feried of not less than thfee (3) years, or for the <br />period neeessM t� ewry oto all netivities that will be fiffided for three (3) Federal fiseal <br />yem, beginning Oetober 1, 1992; provided, however, in no event sitall this eentraet term <br />extend beyond a period of f ve (S) years beginning October 1, 1997; a review <br />of the contract will begin at least six months prior to its expiration; <br />2. The contract maybe amended to provide for a change in the managing body or the <br />funding formula or any other component, provided such a request for change is submitted to <br />the Commission at least niney (90) days before the beginning of the fiscal year (July]). The <br />Commission will consider the request and communicate with each MEMBER regarding the <br />• request to develop consensus on the change requested. <br />3. The contract may be terminated by any MEMBER with ninety (90) day written notice of <br />intent to withdraw, prior to the beginning of the focal year, beginning July I of each year. It <br />is understood that termination of this contract by any one MEMBER may have the effect of <br />discontinuing the CONSORTIUM, and the forfeiture of future federal funding under the <br />HOME Investment Partnership program for all MEMBERS. <br />Administrative Ca an bility <br />The MEMBERS of the CONSORTIUM further assert that there is sufficient authority and <br />administrative capability to carry out the purposes of the HOME Investment Partnership Program <br />including but not limited to the following agencies as affirmatively furthering fair housing: <br />• The Albemarle Housing Improvement Corporation, serving Albemarle County; <br />• The Charlottesville Redevelopment and Housing Authority <br />Improvement Projeet-, serving the City of Charlottesville; <br />• The Fluvanna County Gernmurtity Deveiepment Housing Foundation, serving Fluvanna <br />County; <br />• The Skyline Community Action Program, serving Greene County; the Rapiden Better <br />Housing Cerpe—tion, <br />• The Louisa County Housing Foundation, serving Louisa County; <br />• HOME CONSORTIUM Agreement draft (8/25/97) 3 <br />iteeerdanee with the GEWSORTFUNI's <br />E3etnprehensive Housing Affordability Strategy <br />fGILks?; <br />3.
