RESOLUTION APPROVING AN AMENDMENT TO THE <br />SPECIAL USE PERMIT GRANTED TO NORTHSIDE BAPTIST CHURCH <br />FOR PROPERTY AT 1414-1416 WESTWOOD ROAD. <br />WHEREAS, Northside Baptist Church, owner of the Northside Christian Daycare Center <br />at 1414 Westwood Road, has requested an amendment to the special use permit granted on April <br />4, 1994, to allow expansion of the daycare center in place of the approved private school/daycare <br />center. This property is further identified as Parcel 28.40 on City Real Property Tax Map 4, <br />having approximately 227 feet of frontage on Westwood Road, and containing approximately <br />111,858 square feet of land or 2.57 acres; <br />WHEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on May 13, 1997, this Council finds that such use will <br />conform to the criteria applicable to special permits generally under Chapter 34 of the City Code; <br />now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that an <br />amendment to the special use permit granted on April 4, 1994 is hereby approved and granted to <br />Northside Baptist Church, owner of 1414-1416 Westwood Road, to allow expansion of the <br />daycare center in place of the approved private school/daycare center. This expansion will <br />include addition of a gymnasium along with modifications to the existing building. This <br />amendment to the special use permit is conditioned upon the following: <br />• 1. Administrative approval of the amended site plan. <br />2. Administrative approval of a grading and soil erosion/sedminent control plan, <br />including data on the linear feet of pipe, silt fence, curbs and other types and numbers of drainage <br />structures, to assist in setting the bond amount. The drainage should take into consideration any <br />water draining onto the property. <br />3. The minimum of 15% enrollment for infant care in the day care shall continue to be <br />maintained, as required by the April 4, 1994 special use permit. <br />4. The times of operation of the daycare center shall continue to be limited to weekdays <br />from 6:00 am. to 6:00 p.m., and that no outside play activities occur before 8:00 a.m. After <br />school events shall only be allowed inside and must be completed by 9:30 p.m. <br />5. The number of children occupying the day care facilities shall not exceed 198. <br />6. The number of children in the 2 and 3 year old playground shall be limited to 25 at a <br />time and the number of children in the play areas designated for children 4 and older shall be <br />limited to 70 at a time. <br />7. The gymnasium shall be constructed of brick veneer and standing seam metal in <br />keeping with the character of the adjacent neighborhoods and that all other additions be brick <br />veneer in keeping with the existing complex. <br />8. The design of the gymnasium shall be the first of the two alternatives submitted by the <br />applicant, with brick at the lower level and dryvit with fixed non see-through windows near the <br />top. <br />• 9. The day care center owners shall provide for monitoring of traffic using the site during <br />peak hours of operation and during special events/games at the site. <br />10.
