RESOLUTION • APPROVING A SPECIAL USE PERNHT FOR AN AMUSEMENT ARCADE TO BE LOCATED AT 301 EAST MAIN STREET WHEREAS, Townsquare Associates, owner of the property at 301 East Main Street has requested a special use permit to use a portion of the building at 301 East Main Street and 3rd Street, N.E. for an amusement arcade. This property is further identified as Parcel 231 on City Real Property Tax Map 33, having approximately 48 feet of frontage on East Main Street, 100 feet of frontage on 3rd Street, N.E., and containing approximately 7,649 square feet of land or .18 acres; WHEREAS, following a joint public hearing before this Council and the Planning Commission, duly advertised and held on November 11, 1997, this Council finds that such use will conform to the criteria applicable to special permits generally under Chapter 34 of the City Code; now, therefore BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a special use permit is hereby approved and granted to Townsquare Associates, owner of the property at 301 East Main Street, to use a portion of the building at 301 East Main Street and 3rd Street, N.E. for an amusement arcade with no more than eight (8) billiard tables. This approval is • conditioned upon the following: (1) That the amusement arcade be located in the area shown on the approved site plan consisting of approximately 654 square feet of floor area at the rear of 301 East Main Street on two levels and accessed through the restaurant only. (2) That the hours of operation only be during hours of operation for the restaurant, and no later than 2:00 a.m. (3) That at all times during operation, a manager and a minimum of one additional employee be on duty at the restaurant to monitor use of the amusement arcade. (4) That the amusement arcade not be used for gaming or other activities requiring special state license (such as lotto, or off-track betting). (5) Some billiard tables must be in areas accessible to individuals with disabilities. (6) That the entire area devoted to the billiard table activity not exceed 15% of the gross floor area. (7) That the amusement arcade consist of no more than eight (8) billiard tables and shall not • include arcade games. Approved by Council ..�,, December 1, 1997 &drk of City Council
