receiving evidence satisfactory to Authority that Buyer has procured a construction loan commitment <br />• or other financing on such terms and in such amount as Authority deems sufficient to permit Buyer <br />to fulfill its obligations under this Agreement, including the completion of construction of the <br />improvements on the Property in accordance with the approved site plan. Nothing contained herein, <br />and no action of Authority or City Council in approving or failing to approve any budget or <br />financing, shall be deemed or construed as making any party a partner or joint venturer with any <br />other party or create a principal -agent relationship or any other relationship except that of seller and <br />buyer. <br />11.3 The deed for the Property shall contain a restrictive covenant running with the <br />Property prohibiting the Property from being used for the following uses: service stations; television <br />and household appliance repair stores; laundromats and self-service cleaning establishments; <br />laundries; dry cleaning establishments; car washes; sign painting businesses; bicycle sales and <br />service; radio, television, telegraph and electricity transmission towers; animal shelters or hospitals; <br />drive-in restaurants; amusement arcades; auto, motorcycle, farm and industrial equipment dealers <br />and repair; frozen food lockers; drive-in theaters; mobile home sales; plumbing, heating, electrical, <br />air conditioning and similar establishments; tire sales and recapping; mass transit terminals; and <br />warehouses. <br />WITNESS the following duly authorized signatures. <br />• Seller: Buyer: <br />THE INDUSTRIAL DEVELOPMENT PIEDMONT BUILDING & <br />AUTHORITY OF THE CITY OF DEVELOPMENT CORPORATION <br />CHARLOTTESVILLE, VIRGINIA <br />Un <br />Kurt Schlegel <br />Its: President <br />Attachment: Exhibit A (the Property drawing) <br />Page 7 <br />
