FROM . 1 804 225 8356 01-29-98 02:35PM TO 16049703523 u115 P.2i6 <br />• RESOLUTION AMENDING THE SERVICE AGREEMENT <br />ALBEMARLE-CHARLOTTESVILLE REGIONAL JAIL AUTHORITY <br />Be it Concurrently Resolved by the Albemarle -Charlottesville Regional Jail Authority, <br />the Board of Supervisors of'Albemarle County, and the City Council of the City oJ' <br />Charlottesville: <br />I. RECITALS <br />The ALBEMARL:F.-CHARLOTTESVILLE REGIONAL. JAIL AUTHORITY <br />(hereafter the "Authority") and the COUNTY OF ALBEMARLE and the CITY OF <br />CHARLOTTESVILLE, political subdivisions of the Commonwealth of Virginia (collectively <br />the "Member Jurisdictions") have previously approved and executed a Service Agreement <br />dated November 15, 1995, (the "Service Agreement"), creating the Authority and specifying <br />the terms and conditions under which (1) the Authority will operate the Albemarle - <br />Charlottesville Regional Jail (the "Jail") and (2) the Member Jurisdictions will commit <br />prisoners to the Jail and pay the charges assessed by the Authority for keeping such prisoners. <br />In preparing to issue bonds to fund the cost of the improvements planned for the Jail. <br />the Authority has determined that certain amendments to the Service Agreement are necessary <br />• <br />and appropriate to secure the most favorable terms for the sale of such bonds, and has <br />approved and recommended these amendments to the Member Jurisdictions. Now, therefore, <br />in consideration of the mutual benefits and obligations described in the amended sections. the <br />parties agree to amend the Service Agreement as follows: <br />II. AMENDMENTS <br />A. Section 5.1 of the Service Agreement is deleted in its entirety and replaced with the <br />following: <br />Section 5.1 Payments from Member Jurisdictions <br />(a) Per Diem Prisoner Payments. <br />(1) In preparing its Annual Budget, the Authority shall establish a per diem <br />charge for the care, maintenance and subsistence of Prisoners from Member <br />Jurisdictions during the next Fiscal Year. This per diem charge shall consist of <br />two components, including an Operating Component, and a prisoner -based <br />Debt Service Component. The Operating Component shall be calculated to <br />produce revenues that equal the Authority's projected Net Operating Expenses <br />for such Fiscal Year and the Debt Service Component shall he calculated to <br />produce revenues equal to the portion of the Authority's Net Debt Servicc for <br />such Fiscal Year includable in such per diem charge under the provisions of <br />
