• RESOLUTION APPROVING A SPECIAL USE PERMIT <br />FOR PROPERTY AT 100 WEST MAIN STREET <br />ON THE DOWNTOWN MALL <br />WHEREAS, Oliver Kuttner, on behalf of Hampshire Investments Ltd., has requested a <br />special use permit to allow for the addition of up to forty (40) dwelling units to the property at 100 <br />West Main Street and 1 It Street South on the downtown mall at a density of 105 dwelling units per <br />acre instead of the 21 dwelling units per acre allowed by right. This property is further identified as <br />Parcel 19 on City Real Property Tax Map 19, having approximately 76 feet of frontage on West <br />Main Street, 227 feet of frontage on I" Street South, 68 feet of frontage on Water Street, and <br />containing approximately 16,326 square feet of land or .375 acres; <br />WHEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on September 14, 1999, this Council finds that such use will <br />conform to the criteria applicable to special permits generally under Chapter 34 of the City Code; <br />now, therefore <br />BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a special use <br />permit is hereby approved and granted to Hampshire Investments Ltd., owner of the property at 100 <br />West Main Street to allow for the addition of up to twenty-eight (28) dwelling units to the subject <br />• property at a density of 105 dwelling units per acre. This special use permit is conditioned upon: <br />Administrative approval of the site plan with the following items addressed: <br />a. Detailed design of outdoor lighting fixtures that will minimize outward glare to <br />adjacent properties. <br />b. Signs (location, character, size, height & orientation) in accordance with Chapter 34, <br />Article XXX, City Code. <br />C. Existing/proposed contour lines at intervals of 5 feet or less. <br />d. Indication of the type of vegetation that will be provided. <br />e. Signature Panel for approval and date. <br />f Details of bollards or any other measures used to block traffic. <br />g. Indication of the pavement material proposed for the pedestrian area. <br />h. Details of any railings that will be used near the plaza or lowered sidewalk. <br />i. Details on roof drain connections to storm drain system. <br />j. Details and materials proposed for streetscape design, lighting, railings, tree wells, <br />benches, bollards, loading areas, curb cuts, sidewalks, doorway entrances, on both <br />sides of 1" Street and Water Street for those areas adjacent to the former <br />Woolworth's Building. <br />k. Provision of a street profile to ensure any and all utility/wall conflicts are resolved. <br />1. Details and clarification on all utility items and encroachment into the right-of-way <br />as outlined in the staff approval subject to final administrative review. <br />0 2. Provision of one handicapped parking space within 200 feet of the building as part of any <br />modifications to I" Street South. <br />
