seeding until utilized by the RSWA, it being understood that the purpose of the temporary <br />• seeding shall be to mitigate views of unvegetated areas that are not used for greater than ninety <br />(90) days. The exact boundaries of Cell 5 are subject to DEQ approval; however, the area in <br />terms of acreage of Cell 5 as built shall be less than or equal to the area for Cell 5 depicted in <br />Exhibit 1. Exhibit 2 is a copy of the Mitigation Plan consisting of a cover sheet and sixteen (16) <br />drawings dated August 25, 2000 prepared by Land Planning and Design Associates, Inc., <br />(LPDA) which is attached hereto and incorporated herein. Also incorporated into Exhibit 2 and <br />thus into this Agreement, are two "technical specifications" prepared by LPDA related to <br />"Planting Soil" and "Exterior Plants" that will be applied during the implementation of the <br />Mitigation Plan. The RSWA agrees to replace damaged, dying and dead plant materials with <br />plants meeting the "technical specifications" incorporated into the Mitigation Plan to the extent <br />such replacement is necessary to maintain the effectiveness of the visual screening established by <br />the Mitigation Plan. <br />• <br />3. RSWA shall establish a program to prevent, to the extent reasonably <br />possible, any hazardous waste, including hazardous waste from small quantity generators, or <br />solid waste which would be classified as municipal solid waste (MSW) (other than that generated <br />in relatively insignificant amounts during construction, demolition, or land clearing activities in <br />comparison with the delivered load) from being disposed of in Cell 2 or Cell 5. The Parties <br />agree that the following items are customarily accepted for disposal as CDD waste and may be <br />disposed of in Cell 2 or Cell 5 even if they are not generated during construction, demolition, or <br />land clearing activities, unless prohibited by DEQ: (i) "bulky items", such as old furniture, white <br />goods, and similar large household items brought to the landfill under a City/County program for <br />special pickup of large items from citizens on call; (ii) large cardboard boxes, used appliances or <br />3 <br />
