The preceding sentence shall <br />• not alter the right of the RSWA to develop Cell 8 for MSW disposal consistent with the terms of <br />this Section AA of this Agreement. <br />5. The RSWA agrees that it will not dispose of MSW or CDD waste in the <br />area identified as Cell 4 on Exhibit 1 attached hereto. The RSWA also agrees that it will limit <br />inert waste disposal in the area identified as Cell 4 to the area depicted in the Mitigation Plan <br />attached as Exhibit 2. The RSWA further agrees that the only other waste management activities <br />it may conduct in the Cell 4 area will be the storage and related grinding of any land clearing <br />debris and/or vegetative and woody waste or debris that may be received in such volume by the <br />Ivy landfill after an "extraordinary weather event," such as severe wind storms, hurricanes, <br />tornadoes, or other natural disasters, that overwhelm the areas at the Ivy landfill ordinarily <br />designated for such activities on the Mitigation Plan attached hereto as Exhibit 2. If an <br />• "extraordinary weather event" does occur, RSWA will use its best efforts to store and grind any <br />excess land clearing and/or vegetative and/or woody waste or debris that is generated by such <br />event in Cell 8 before proceeding to Cell 4 for such purposes if Cell 8 is reasonably available for <br />such purposes at the time. The Parties agree that the Cell 5 and Cell 8 areas, depicted on <br />Exhibit 1, are the only areas where waste disposal cells will be developed at the Ivy landfill in <br />the future. <br />• <br />6. Plaintiffs acknowledge that RSWA is currently operating a materials <br />recovery facility, a transfer station, a composting facility, and wood chipping operations at the <br />Ivy landfill, in addition to present CDD waste disposal in Cell 2 and future CDD waste disposal <br />in Cell 5, pursuant to DEQ permit numbers 125 (for solid waste disposal), 132 (for the MSW <br />transfer station operations), and 593 (for the composting operations).
