RSWA will conduct the groundwater monitoring at the Ivy landfill in accordance with the <br />• VSWMR. The groundwater monitoring well on the property of the Batton Plaintiffs and the <br />additional groundwater monitoring wells described in Section B hereof that are not part of the <br />DEQ approved compliance well monitoring network, will serve, inter alfa, as "sentinel" wells <br />designed to detect groundwater contamination, if any, migrating from the landfill onto the <br />property owned by any of the Plaintiffs. The Batton Plaintiffs will forthwith provide the RSWA <br />with all available information concerning the construction and monitoring of the monitoring well <br />constructed by them on the property currently owned by them. The RSWA reserves the right <br />(after consultation, with respect to well construction specifications and the propriety of the <br />location of the well, with the consultants, if any, retained by the Batton Plaintiffs whose expense <br />shall be borne by the Battons), to use the already constructed well as a "sentinel" well, or to <br />construct one new monitoring well to serve as the "sentinel" well, in a location as close as <br />• possible, consistent with appropriate siting and construction criteria, to the existing monitoring <br />well constructed by the Batton Plaintiffs. If the RSWA chooses to continue to use the existing <br />groundwater monitoring well constructed by the Batton Plaintiffs, the well will be secured by a <br />• <br />double lock system with one set of keys in the custody and under the control of the Batton <br />Plaintiffs, and the other set of keys for the well will be in the custody and under the control of the <br />RSWA, it being understood that the purpose of the double lock system at the "sentinel" well is to <br />ensure that the well cannot be accessed without the direct participation of the RSWA and the <br />representatives of the Batton Plaintiffs for groundwater sampling events at the frequency <br />required by the VSWMR for the approved groundwater monitoring compliance network and in <br />accordance with the sampling protocol set forth below. The "sentinel" well shall be kept locked <br />and secured at all times except when it is sampled in accordance with the terms of this <br />14 <br />
