• RESOLUTION <br />EXTENSION OF 2001 OUTDOOR CAFE PERMITS <br />WHEREAS, City Staff is currently studying the annual process by which applications <br />for the use of public sidewalks and the downtown mall as outdoor cafe areas are reviewed and <br />granted; and <br />WHEREAS, staff recommendations for revisions to this process, as well as the <br />ordinances set forth in Chapter 28 of the City Code, are expected to be completed in time to be <br />considered by City Council in December 2001; and <br />WHEREAS, the outdoor cafe permits granted for the 2001 cafe season will expire on <br />November 30, 2001, and this Council desires to extend existing permits to allow permit holders <br />who desire to do so to continue operating through the end of the calendar year, subject to the <br />agreement of such permit holders to be responsible for the costs of removing any ice and snow <br />which may accumulated within their outdoor cafe areas during the extended period of time; <br />NOW, THEREFORE, BE IT RESOLVED that all outdoor cafe permits issued by the <br />City pursuant to Chapter 28, Article VI, Division 2 of the City Code, for the season extending <br />from March 1, 2001 through November 30, 2001 are hereby extended, and shall remain in effect, <br />through December 31, 2001. No new permits shall be issued by the City for the period of <br />December 1, 2001 through December 31, 2001. <br />• BE IT FURTHER RESOLVED that during the period of this extension, it shall be a <br />condition of the extended permit that each permit holder who chooses to continue operations <br />shall be responsible for keeping his cafe area free and clear of ice and snow. In the event the <br />City's zoning administrator determines that a permit holder has failed to meet this requirement, <br />the permit in question shall immediately expire and the permit holder shall be required to <br />reimburse the City for any costs incurred by the City to clear the area of accumulated ice and <br />snow. <br />Approved by Council <br />November 19, 2001 <br />4rl��of City Council <br />0 <br />
