CITY MANAGER'S <br />• EMPLOYMENT AGREEMENT <br />(beginning November 1, 200 1) <br />THIS AGREEMENT, made and entered into this 1st day of November, 2001, by <br />and between the Council of the City of Charlottesville, Virginia, a municipal corporation, <br />hereinafter called City Council, as party of the first part, and Gary O'Connell, hereinafter <br />called Manager, as party of the second part, both of whom understand as follows: <br />WITNESSETH: <br />WHEREAS, the City Council desires to employ the services of Gary O'Connell as <br />its City Manager as provided by the City Charter and Code; and <br />WHEREAS, it is the desire of the City Council to provide certain benefits, establish <br />certain conditions of employment and to set working conditions of said employee; and . <br />WHEREAS, it is the desire of the City Council (1) to retain the services of the <br />Manager and to provide inducement for him to remain in the City's employment, (2) to make <br />possible full work productivity by assuring the Manager's morale and peace of mind with <br />• respect to future security, and (3) to provide a just means for terminating the Manager's <br />employment when City Council may desire to do so; and <br />WHEREAS, the Manager desires to continue employment as City Manager of <br />Charlottesville; <br />NOW, THEREFORE, in consideration ofthe mutual covenants described below, the <br />parties agree as follows: <br />SECTION 1. EMPLOYMENT <br />City Council hereby agrees to employ Gary O'Connell as City Manager to perform <br />the functions and duties specified in the City Charter and Code of the City of Charlottesville, <br />Virginia and to perform other legally permissible and proper duties and functions that the <br />Council shall assign from time to time. <br />SECTION 2. INITIAL TERM AND RENEWALS <br />A. The term of this agreement shall be from November 1, 2001 to October 31, 2006, <br />• unless sooner terminated by either party in accord with provisions of this agreement. <br />
