• RESOLUTION <br />AUTHORIZING PROCEEDINGS FOR <br />ABATEMENT OF THE NUISANCE OF A BLIGHTED PROPERTY <br />LOCATED AT <br />2210 NORTH BERKSHHZE <br />WHEREAS, pursuant to §5-193 of the City Code, the Director of Neighborhood Development <br />Services ("Director") did, on or about March 3, 2004, make a preliminary determination that the property <br />located at 2210 North Berkshire Road (City Tax Map 40C Parcel 74) is a blighted property, and provided <br />written notice thereof to the owner of the Property, as required by §5-193; and <br />WHEREAS, the Director's determination was based on his finding that the Property exists in an <br />unsafe condition due to problems in the following areas: "...plumbing, water system, exterior egress, <br />windows and window frames, door frames, decay of interior surfaces and other defective surface <br />conditions...."; and <br />WHEREAS, Owner of the Property failed to respond to the Director's notice within 30 days, to <br />provide a suitable plan to cure the blight; and <br />WHEREAS, at the Director's request the Planning Commission conducted a public hearing on <br />_May 11, 2004 and made findings and recommendations regarding the repair or other disposition of the <br />Property, and on behalf of the Commission the Director has made a report of those findings to this City <br />• Council; and <br />'WHEREAS, the Director and Planning Commission recommend demolition/removal of the <br />structure located on the Property; <br />NOW THEREFORE, be it resolved: <br />THAT this Council affirms and accepts the findings and recommendations of the Director and <br />Planning Commission, and in lieu of acquisition of the Property by the City through exercise of its <br />powers of eminent domain, and in lieu of having City staff perform improvements to the house to bring <br />the Property into compliance with applicable building codes, this Council hereby states its intention to <br />declare the Property a nuisance, and to abate such nuisance in accordance with the procedures set forth in <br />§5-198 of the City Code; and <br />THAT the Director is hereby directed to send a copy of the attached proposed ordinance by <br />certified mail, return receipt requested, to the Owner(s) of the property, and to any lienholder(s) of record. <br />The notice shall advise all such persons that if corrective action is not taken on or before July 19, 2004 <br />this Council will consider the attached proposed ordinance at its regular meeting on said date, and <br />THAT if the Owner has failed to abate the blight prior to the date on which an ordinance is finally <br />adopted by council, the Director shall follow,the abatement process specified within City Code §5-196(c). <br />Approved by Council <br />June 21, 2004 Ce k of City Council <br />• <br />
