• RESOLUTION <br />APPROVING A SPECIAL USE PERMIT <br />IN CONNECTION WITH THE DEVELOPMENT OF <br />PROPERTY LOCATED AT 1508 GRADY AVENUE <br />WHEREAS, Keith Woodard ("Applicant") has requested a special use permit with respect to <br />property identified on City Tax Map 5 as Parcel 75 (1508 Grady Avenue), consisting of approximately <br />0.5370 acres ("Subject Property"), to authorize use of the property as either: (i)a boarding house; or (ii) a <br />boarding, fraternity and sorority house; and <br />WHEREAS, the Subject Property is zoned "R-UMD" (University Medium Density District), <br />where, pursuant to §34-420 of the City Code, "boarding house" and "boarding, fraternity and sorority <br />house" are allowed only by Special Use Permit; and <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on September 13, 2005, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, on September 13, 2005, based on the information presented by Neighborhood <br />Development Services staff as well as by the Applicant, the Planning Commission recommended that the <br />application be approved as submitted, subject to certain recommended conditions; and <br />WHEREAS, this Council finds and determines that the Applicant's requested uses (i) will be in <br />harmony with the purposes and intent of Article I, Division 8 of the City's zoning ordinance and of the R- <br />UMD zoning district; and <br />WHEREAS, this City Council finds and determines that granting the requested Special Use <br />Permit would be consistent with the City's zoning ordinance and the criteria generally applicable to <br />special use permits under Chapter 34 of the City Code; now, therefore, <br />BE IT RESOLVED by the Charlottesville City Council that: <br />(1) A special use permit is hereby granted to allow the Subject Property to be used as either a <br />boarding house or a boarding, fraternity and sorority house; and <br />(2) There shall be no more than twelve (12) bedrooms located on the property—up to ten (10) <br />bedrooms in the main building and up to two (2) additional bedrooms (one per unit) in the <br />accessory structure located to the rear of the Subject Property; and <br />(3) The footprint of the main building shall not be expanded. <br />Approved by Council <br />October 3, 2005 <br />ua <br />Cle f City Council <br />4 <br />
