RESOLUTION <br />• APPROVING A SPECIAL USE PERMIT FOR HIGHER DENSITY <br />RESIDENTIAL DEVELOPMENT <br />ON PROPERTY IDENTIFIED AS 12910TH STREET, N.W. <br />WHEREAS, pursuant to the Code of the City of Charlottesville, section 34-464(1), <br />William G. Chapman, on behalf of Tenth and Main, LLC, has requested a special use permit to <br />allow additional residential density for property located at 129 10`h Street, N.W., identified on <br />City Tax Map 10 as Parcel 39 ("Property"), which Property contains approximately 29,795 <br />square feet (0.6840 acre); <br />WHEREAS, a public hearing on this application was conducted by the Planning <br />Commission on June 14, 2005, following notice to the public and to adjacent property owners as <br />required by law and thereafter, the Planning Commission voted to recommend approval of the <br />proposed special use permit; and <br />WHEREAS, a public hearing on this application was conducted by this City Council on <br />July 5, 2005, following notice to the public and to adjacent property owners as required by law; <br />and <br />WHEREAS, this application seeks approval of residential density of up to 54 dwelling <br />units per acre (54 DUA), not to exceed thirty-six (36) dwelling units; and <br />• WHEREAS, the subject parcel is currently zoned B-3 (Business District) wherein <br />residential density of up to twenty-one units per acre (21 DUA) is allowed by -right, and <br />additional density, up to 87 DUA, may be authorized by City Council through issuance of a <br />Special Use Permit, pursuant to City Code 534-480; and <br />WHEREAS, the City's Comprehensive Plan designation for the parcel is "University <br />Precinct'; and <br />WHEREAS, upon a review of the criteria generally applicable to special use permits <br />under Chapter 34 of the City Code, this Council finds and determines that the proposed density is <br />appropriate; now, therefore, <br />BE IT RESOLVED by the Charlottesville City Council that a special use permit is <br />hereby granted to allow additional residential density up to 54 DUA, not to exceed 36 dwelling <br />units, total, for the property located at 129 10`h Street, N.W.
