SP -06-10-22 <br />• RESOLUTION <br />GRANTING A SPECIAL USE PERMIT TO <br />THE UNIVERSITY OF VIRGINIA FOUNDATION <br />FOR A SEVEN STORY PARKING GARAGE AND MEDICAL OFFICE BUILDING <br />IN THE WEST MAIN SOUTH MIXED-USE ZONING DISTRICT <br />WHEREAS, the University of Virginia Foundation ("Applicant') has requested a special use <br />permit with respect to property identified on City Tax Map 10 as Parcels 60, 61, 63, 81.1, 82 and 83 <br />(located on the south side of West Main Street between 11 m Street and Jefferson Park Avenue), consisting <br />of approximately 2.73 acres (collectively, hereafter the "Subject Property") to allow additional height <br />above that permitted by City Code §34-637; and <br />WHEREAS, the Subject Property is located within the West Main Street South Mixed Use <br />Corridor District ("WMS") and is within the parking exempt area established pursuant to §34-971(e) of <br />the City Code; and <br />WHEREAS, pursuant to §34-637 of the City Code, up to seven (7) stories of building height <br />may be allowed within the WMS zoning district when approved by special use permit; and <br />WHEREAS, the building(s) for which additional height is requested have been identified by the <br />Applicant as one(s) to be used for medical offices and an associated parking garage, and within the WMS <br />zoning district: i) medical offices are allowed by right, and (ii) parking garages that are used ancillary to a <br />• by -right use, such as medical offices, are permitted by right; and <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on October 10, 2006, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, on October 10, 2006, based on the information presented by Neighborhood <br />Development Services staff as well as by the Applicant, the Planning Commission recommended that the <br />application be approved; and <br />WHEREAS, this City Council finds and determines that granting the Special Use Permit would <br />be consistent with City Code Chapter 34, Article VI, Division 6 and with the criteria generally applicable <br />to special use permits under Chapter 34, Article I, Division 8 of the City Code; NOW, THEREFOR, <br />BE IT RESOLVED by the Charlottesville City Council that a special use permit is hereby <br />granted for an increase in building height from five (5) stories to seven (7) stories for the medical office <br />building and ancillary parking garage proposed by the Applicant to be established on the Subject <br />Property. <br />Approved by Council <br />November 6, 2006 <br />CI tyler of CiCouncil <br />
