SP -06-9-10 <br />• RESOLUTION <br />APPROVING A SPECIAL USE PERMIT <br />TO KEITH WO,ODARD <br />TO ALLOW USE OF THE PROPERTY AT 322 le" STREET, N.W. <br />AS A BOARDING/ROOMING HOUSE. <br />WHEREAS, Keith Woodard ("Applicant') has requested a special use permit with respect to <br />property identified on City Tax Map 4 as Parcel 287 (322 14'h Street, N.W.), consisting of approximately <br />0.209 acres ("Subject Property"), to allow use as a boarding house or rooming house; and <br />WHEREAS, the subject parcel is zoned."R-UHD" (Residential -University High Density) with <br />overlay zoning in the Rugby Road/University Circle/Venable Architectural Design Control District, <br />where, pursuant to §34-420 of the City Code, boarding houses or rooming houses are allowed by Special <br />Use Permit; and <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on September 13, 2006, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, on September 13, 2006, based on the information presented by Neighborhood <br />Development Services staff as well as by the Applicant, the Planning Commission recommended that the <br />application be approved, with conditions; and <br />• WHEREAS, this City Council finds and determines that granting the Special -Use Permit would <br />be consistent with City Code §34-420 and the criteria generally applicable to special use permits under <br />Chapter 34 of the City Code; now, therefore, <br />BE IT RESOLVED by the Charlottesville City Council that a special use permit is hereby <br />granted to allow use of the Subject Property as a boarding house or rooming house, subject to the <br />following conditions: <br />1. Changes to the existing parking lot shall require site plan approval and approval by the Board of <br />Architectural Review; and <br />2. The boarding house or rooming house shall have no more than six (6) bedrooms and no more <br />than eight (8) occupants. <br />Approved by City Council on October 2, 2006 <br />+Jeeox, Clerk of Council <br />0 <br />
