RESOLUTION <br />APPROVING AN AMENDMENT TO THE SPECIAL USE PERMIT <br />• APPROVED ON JUNE 4, 2007 (INFILL DEVELOPMENT) <br />TO ALLOW A REDUCED REAR YARD SETBACK <br />AT 513 DICE STREET <br />WHEREAS, Jane Covington ("Applicant') has requested an amendment to the special use <br />permit granted by City Council on June 4, 2007, with respect to property identified on City Tax Map 29 <br />as Parcel 63.1 (513 Dice Street), consisting of approximately 0.21 acres ("Subject Property"), to allow a <br />reduction in the rear yard setback from the required 25 feet to 10 feet; and <br />WHEREAS, at its meeting on June 4, 2007, City Council conditioned approval of the special use <br />permit on the issuance of a Certificate of Appropriateness from the Board of Architectural Review <br />(BAR); and <br />WHEREAS, the BAR at its meeting on June 19, 2007, recommended placement of the new <br />single family dwelling at the rear of the Subject Property, to line up with the northeast comer of the <br />existing historic structure (Shackleford-Bannister House); and <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on August 14, 2007, following notice to the public and to adjacent property owners <br />as required by law; and <br />WHEREAS, on August 14, 2007, based on the information presented by Neighborhood <br />Development Services staff, as well as by the Applicant and the Board of Architectural Review, the <br />• Planning Commission recommended that the application be approved; and <br />WHEREAS, this City Council finds and determines that granting the amendment to the Special <br />Use Permit would be consistent with City Code §34-165, e[ seq. and the criteria generally applicable to <br />special use permits under Chapter 34 of the City Code; now, therefore, <br />BE IT RESOLVED by the Charlottesville City Council that the Special Use Permit for the Subject <br />Property approved by this Council on June 4, 2007, is hereby amended to allow reduction of the rear yard <br />setback from 25 feet to 10 feet.
