6. The responsibility for investigation and subsequent actions within the requesting <br />Ojurisdiction shall remain with the law enforcement agency of the requesting party. Entering law <br />enforcement personnel shall promptly notify the agency of the entered jurisdiction upon <br />discovery of a crime in the jurisdiction where the offense occurred. <br />7. Any officer acting pursuant to this Agreement shall be granted authority to <br />enforce the laws of the Commonwealth of Virginia and to perform the other duties of a law <br />enforcement officer, and shall have the same authority in the requesting locality as he has within <br />the locality where he was appointed. Such authority shall be in conformance with Va. Code <br />sections 15.2-1724, 15.2-1730, and 15.2-1736 as may be applicable; however, law enforcement <br />officers of any jurisdiction who might be casually present in any other jurisdiction shall have <br />power to apprehend and make arrests only in such instances where an apparent, immediate threat <br />to public safety precludes the option of deferring action to the local law enforcement agency. <br />O8. With regard to the execution of search or arrest warrants in one jurisdiction, where <br />40 <br />such warrants have been issued for or in connection with an ongoing criminal investigation <br />conducted by the other jurisdiction, the following shall apply: <br />(a) Each agency shall provide the other with advance notice, reasonable under the <br />circumstances, of any planned entry into the other jurisdiction for the purpose of executing a <br />warrant pursuant to this provision (the "Notice of Entry"). This Notice shall be provided to the <br />ranking officer on duty in the jurisdiction where the warrant is to be executed. <br />(b) The presence of officers from the jurisdiction where the warrant is to be executed <br />shall not be required; however, that jurisdiction shall have the option of sending one of its <br />officers to execute the warrant, or to attend to its execution. <br />3 <br />
