Resolution <br />is Waiving Caff Rental and Vendor Stand Fees <br />during Downtown Mall Reconstruction <br />WHEREAS, the planned restoration of the Downtown Mall will temporarily prevent downtown <br />restaurants from operating sidewalk cafes during a portion of the mall construction; and <br />WHEREAS, vendors will not be allowed to set up tables on the Downtown Mall during at least <br />a portion of the construction period; and <br />WHEREAS, City Council desires to mitigate the negative impact on businesses and vendors <br />during the reconstruction of the Downtown Mall during the spring and summer of 2009; now, therefore, <br />BE IT RESOLVED by the City Council of the City of Charlottesville that: <br />1. The fee for cafe permits, imposed under City Code Section 28-211, for Downtown Mall <br />restaurants will be waived for the period of March 1, 2009 through November 20, 2009. <br />This waiver shall remain in effect even if a restaurant is permitted by the City to operate <br />a sidewalk caf6 on the Downtown Mall prior to November 20, 2009. <br />2. Vendor stand space fees, imposed under City Code Section 28-116, for Downtown Mall <br />street vendors shall be waived for the period of January 1, 2009 through March 31, <br />• 2009. During the construction period street vendors will be allowed to set up tables only <br />at the east end of the Downtown Mall in front of City Hall, at such locations assigned by <br />the Neighborhood Development Services staff. <br />3. Sidewalk cafe operations and vendor stands will be authorized to resume as soon as <br />conditions on their assigned street block allow for the safe operation of such cafes and <br />vendor stands, as determined by the City's Construction Project Manager. <br />Approved by Council <br />December 15, 2008 <br />Cqerk of City Council <br />
