• RESOLUTION GRANTING A SPECIAL USE PERMIT <br />TO FIRST STREET VENTURES LLC <br />TO OPERATE A DANCE HALL AT 101 & 103 SOUTH FIRST STREET. <br />WHEREAS, First Street Ventures LLC, lessee of commercial building space on property at <br />101 and 103 South First Street, owned by K Holdings LLC, has requested a special use permit with <br />respect to the property identified on City Tax Map 28 as Parcel 19, consisting of approximately <br />4,994 square feet ("Subject Property), to allow operation of a dance hall; <br />WHEREAS, K Holdings LLC supports the request for a special use permit by First Street <br />Ventures LLC to use the leased space as a dance hall; and <br />WHEREAS, the Subject Property is zoned Downtown Corridor Mixed Use District, and, <br />pursuant to §34-796 of the City Code, such modifications for use of the property are allowed by <br />Special Use Permit; and <br />WHEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on July 14, 2009, this Council finds that such use is allowed <br />under City Code Section 34-796, and will conform to the criteria applicable to special permits <br />generally under Chapter 34 of the City Code; now, therefore <br />• BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a special use <br />permit is hereby approved and granted to allow operation of a dance hall at 101 and 103 South First <br />Street. Approval of this special use permit is conditioned upon the following: <br />There shall be no audible noise, detectable vibration or odor beyond the <br />confines of the building in which the dance hall is located, including <br />transmittal through vertical or horizontal party walls, between the hours of <br />2:00 a.m. and 8:0.0 a.m. <br />Approved by Council <br />August 17, 2009 <br />Ao�� <br />6kA of City Council <br />11 <br />
