136 <br /> <br />Avenue Baptist Church was to be moved back to Clark <br />Elementary School as renovations would be completed there <br />before the next election. <br /> <br /> As there was no one to speak, the public hearing was <br />closed. <br /> <br />ORDINANCE: RELOCATING VOTING PRECINCTS <br /> <br /> On motion by Mr. Barnes, seconded by Mrs. Gleason, the <br />ordinance entitled "AN ORDINANCE TO AMEND SECTION <br />8-2 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS <br />AMENDED, TO RETURN CLARK ELEMENTARY SCHOOL AS THE LOCATION <br />FOR CLARK SCHOOL PRECINCT AND TO TEMPORARILY MOVE THE <br />LOCATION OF VENABLE SCHOOL PRECINCT TO WESTMINSTER <br />PRESBYTERIAN CHURCH" was offered and carried over to the <br />next meeting for consideration. <br /> <br />PUBLIC HEARING: ACQUISITION OF CSX PROPERTY <br /> <br /> Mr. Jack Chambers, Vice-Chairman of the Charlottesville <br />Industrial Development Authority, Stated that the Authority <br />proposes to purchase the CSX property for $1.5 million. The <br />Authority will then sub-divide and sell the property, <br />selling a portion to the City for $283,000 for public <br />parking. Mr. Chambers stated that the contract to purchase <br />the property is contingent upon Council approval following <br />the public hearing. <br /> <br /> Mr. George Ray, Economic Development Coordinator, <br />gave a slide presentation showing the property proposed to <br />be purchased by the Authority. <br /> <br /> Ms. Cecile Gorham, representing the patrons of the <br />Charlottesville City Market, requested that Council consider <br />providing land to house the City Market on the CSX property. <br />Ms. Gorham stated that the City Market is a City-sponsored <br />venture and that the present location at Jefferson School is <br />not longer adequate. <br /> <br /> As there were no other speakers, the public hearing was <br />closed. <br /> <br />PUBLIC HEARING: ORDINANCE RESTRICTING SMOKING IN PUBLIC PLACES <br /> <br /> Mr. Clyde Gouldman, City Attorney, reviewed the <br />proposed ordinance restricting smoking in public places and <br />stressed that the ordinance should be expected to be amended <br />as the City gains experience in dealing with the issue. <br /> <br /> Responding to a question from Mr. Barnes about why <br />courthouses are exempt, Mr. Gouldman stated that State law <br />prohibits localities from restricting State. property. <br /> <br /> Mr. Towe questioned the availability of Health <br />Department staff for enforcement of the ordinance. <br /> <br /> Mr. Gouldman stated that while the Health Department is <br />willing to enforce the ordinance, they will not be able to <br />respond at all hours and their main job will be to educate <br />the public and business community regarding the ordinance. <br /> <br /> Dr. Susan McLeod, Director of the Health Department, <br />stated that no additional staff will be hired for <br />enforcement of the ordinance. <br /> <br /> Ms~ M. Vanes, owner of the Italian Villa Restaurant, <br />stated that she was concerned with the smoking restricting <br />in her restaurant, especially when certain sections of the <br />restaurant are closed during slow business hours. <br /> <br /> Dr. McLeod, Director of the Health Department, stated <br />that while she would prefer to see more restrictions in the <br /> <br /> <br />
