~55 <br /> <br /> being adopted, and the terms, conditions and provisions <br /> thereof are hereby approved, and the City Manager is hereby <br /> authorized and directed to execute and deliver the Agreement <br /> in such form together with such changes as shall be approved <br /> by such official upon advice of counsel to the City <br /> (including the City Attorney), such approval to be <br /> conclusively evidenced bY his execution thereof. <br /> <br />ORDINANCE: CLOSING A PORTION OF SUNSET.AVENUE (2nd reading) <br /> <br /> Mr. Barnes stated that he would abstain on the matter due <br /> to a potential conflict of interest. <br /> <br /> Mr. Clyde Gouldman, City Attorney, stated that the Public <br />Works Department had contacted Albemarle County about the <br />construction schedule for the development planned on the <br />portion of Sunset Avenue which is in Albemarle County and they <br />were informed that the earliest construction would begin would <br />be three to four months. Mr. Gouldman stated that setting the <br />closing date for September would allow time for construction of <br />the turnaround and the necessary property acquisition. <br /> <br /> Responding to a question from Mr. Towe, Mr. Hendrix stated <br />that the cost of the closing and turnaround was estimated to be <br />approximately $12,000 and the cost of the land acquisition was <br />unknown at this time. <br /> <br /> Mr. Buck recommended that the closing date be made <br />September 1st so that the road could be closed prior to the <br />beginning of school. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, the <br />ordinance closing Sunset Avenue was unanimously amended to set <br />September 1, 1988 a the closing date. <br /> <br /> The ordinance entitled "AN ORDINANCE CLOSING, VACATING AND <br />DISCONTINUING A PORTION OF SUNSET AVENUE,,, which was offered at <br />the June 6th meeting, was approved by the following vote <br />Ayes: Mr. Buck, Mrs. Gleason, Dr. Ha!l, .Mr. Towe. Noes: <br />None. Abstaining: Mr. Barnes. <br /> <br />ORDINANCE: RELOCATING VOTING PRECINCTS (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND SECTION 8-2 <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, <br />TO RETURN CLARK ELEMENTARY SCHOOL AS THE LOCATION FOR CLARK <br />SCHOOL PRECINCT AND TO TEMPORARILY MOVE THE LOCATION OF VENABLE <br />SCHOOL PRECINCT TO WESTMINSTER PRESBYTERIAN CHURCH,". which was <br />offered at the June 6th meeting, was approved by the following <br />vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. Gleason, Dr. Hall, Mr <br />Towe. Noes: None. · <br /> <br />ORDINANCE: RESTRICTING SMOKING IN PUBLIC PLACES (2nd reading) <br /> <br /> Mr. Gouldman noted that the ordinance had previously been <br /> amended to include food stores which are larger than 8,000 <br /> square feet. Mr. Gouldman stated that concerns about space <br /> leased and restaurants within grocery stores had been raised <br /> which would need to be worked out administratively. <br /> <br /> The ordinance entitled "AN ORDINANCE REGULATING SMOKING IN <br /> PUBLIC PLACES AND CERTAIN PLACES OF EMPLOYMENT,,, which was <br /> offered at the June 6th meeting, was approved by the following <br /> vote. Ayes: Mr. Barnes, Mr. Buck, MrS. ~Gleason, Dr. Hall, Mr. <br /> Toweo Noes: None. <br /> <br /> On motion by Mr. Towe, seconded by Dr. Hall, Council <br /> unanimously voted to immediately ban .smoking in the Council <br /> Chamber, Basement Conference Room, and Community Development <br /> Conference Room in City Hall and to request that the smoking <br /> policy .in City building be implemented as soon as possible. <br /> <br />ORDINANCE: REZONING 1013 LITTLE HIGH STREET FROM R-3 TO B-1 <br /> <br /> <br />
