203 <br /> <br />ORDINANCE: EXPANDING PERMIT PARKING ZONE 4 <br /> <br /> Mr. Hendrix stated that the proposed ordinance <br />expanded permit parking zone 4 to the following areas: <br />area bounded on the north by Farrish, Kelley and Taylor <br />Streets, on the west by Park Street, on the south by East <br />High Street, and on the east by Lexington Avenue. <br /> <br /> Mr. Towe stated that he was not in favor of expanding <br />permit parking zone 4 to any streets other than 7th and 8th <br />Streets, N.E. until additional parking spaces are available <br />on the CSX property. <br /> <br /> Mr. Hendrix stated that very few properties would be <br />eligible for permit parking on streets other than 7th and <br />8th Streets. <br /> <br /> Mr. Towe made a motion to amend the ordinance to <br />include only 7th and 8th Streets in the expanded zone 4. <br /> <br />The motion died for lack of a second. <br /> <br /> Rev. Edwards moved the ordinance, noting that while he <br />was concerned about parking downtown, he was more concerned <br />about neighborhoods. Mr. Vandever seconded the motion and <br />the ordinance entitled "AN ORDINANCE AMENDING AND <br />REORDAINING ARTICLE III OF CHAPTER 26 OF THE CODE OF THE <br />CITY OF CHARLOTTESVILLE~ 1976, AS AMENDED, BY AMENDING <br />SECTION 16-56.2 RELATING TO PERMIT PARKING ZONES" was <br />offered and carried over to the next meeting for <br />consideration. <br /> <br />ORDINANCE: NOISE ORDINANCE <br /> <br /> Mr. Hendrix stated that ~he Chief of Police and City <br />AttOrney have discussed options and the legal difficulties <br />of enforcing the present noise ordinance and the City <br />Attorney has proposed an interim ordinance. <br /> <br /> Mr. Gouldman stated that the proposed ordinance is _ <br />recommended to be used until the General Assembly adopts the <br />necessary enabling legislation to allow enforcement of the <br />existing noise ordinance. Mr. Gouldman stated that while <br />the proposed ordinance is more subjective than the existing <br />ordinance in that it makes unreasonable and disturbing noise <br />unlawful, it has been tested in the courts against vagueness <br />challenges. Mr. Gouldman stated that the Commonwealth's <br />Attorney has recommended that "or warrant" be added to <br />Section 16.2-6 following "summons." <br /> <br /> Ms. Waters recommended that Council hold a public <br />hearing on the proposed noise ordinance on Monday, September <br />26th since the Council will not be meeting for the first <br />meeting in October due to the Virginia Municipal League <br />Conference. <br /> <br /> Mr. Dan Friedman of University Circle, spoke in support <br />of the proposed noise ordinance, stressing that the problems <br />with noise are too great to wait for General Assembly <br />action. <br /> <br /> Mr. Buzz Frahn, Chairman of the University of Virginia <br />Interfraternity Council, stated that while he agreed with the <br />need for an enforceable noise ordinance, he was not sure a <br />hasty, stop-gap measure was reasonable. Mr. Frahn stated <br />that he felt it would be more reasonable to have the police <br />ask to ask to have noise stopped. <br /> <br /> Rev° Edwards stated that he did not think merely having <br />the police ask people to cooperate was practical and that <br />people will not obey the police unless they are required to <br />by law. <br /> <br /> <br />
