208 <br /> <br /> Mr. Hendrix stated that as a matter of public policy a <br />warning and request for voluntary reduction in noise has <br />always been given by the police, and this policy would be <br />continued under the new ordinance. <br /> <br /> Responding to a request for clarification of the <br />penalty by Mr. Vandever, Mr. Gouldman stated that violation <br />of the ordinance would be a Class III penalty, with a $500 <br />maximum fine. <br /> <br /> Rev. Edwards stated that the IFC should be applauded <br />for their efforts to deal with the noise situation and that <br />he felt noise is unreasonable if it interferes with a <br />person's rest or study. <br /> <br /> Mr. Buck stated that IFC self-regulation could be done <br />independent of the ordinance. Mr. Buck stated that <br />reasonable people can understand reasonable restraints and, <br />referring to the comments about vagueness and subjectivity, <br />noted that judges continually apply subjective standards in <br />courtrooms. <br /> <br /> Ms. Waters stated that she did not believe Council was <br />rushing a decision, but instead was turning to the best <br />alternative available at this time as a defense in <br />maintaining livable neighborhoods. Ms. Waters stressed that <br />the community would welcome not having to enforce the noise <br />ordinance. <br /> <br /> Mr. Towe questioned when the ordinance would go into <br />effect and whether the effective date should be made October <br />8th. <br /> <br /> Mr. Gouldman stated that absent any other provision, <br />the ordinance would be effective upon passage. <br /> <br /> Ms. Waters stated that she would support the ordinance <br />becoming effective immediately. <br /> <br /> On motion by Mr. Vandever, seconded by Rev. Edwards, <br />the ordinance was unanimously amended to include emergency <br />generators of health care facility as an exemption. <br /> <br /> The ordinance entitled "AN ORDINANCE REGULATING NOISE <br />CONTROL WITHIN THE CITY OF CHARLOTTESVILLE," as amended, <br />which was offered at the September 21st meeting, was <br />approved by the following vote. Ayes: Mr. Buck, Rev. <br />Edwards, Mr. Towe, Mr. Vandever, Ms. Waters. Noes: None. <br /> <br /> On motion by Mr. Vandever, seconded by Rev. Edwards, <br />Council voted to meet in executive session to discuss <br />personnel matters and disposition of property as exempted by <br />Section 2.1-344(a)(1) and (2) of the Virginia Freedom of <br />Information Act. <br /> <br />Thei meeting was adjourned. <br /> <br /> <br />
