the sales tax to support highway funding, 3/4 of the increase would go to the State and 1/4 would go to cities. Mr. Towe questioned whether Council should make a decision on the matter without giving the public an opportunity to speak. Mrs. Gleason stated that while she agreed that there was a need for the highway projects, she had not been convinced about increasing the sales tax to support the funding. Mr. Barnes stated that he also had concerns with supporting an increase in sales tax. It was the consensus of Council to take no action on the resolution. RESOLUTION: APPOINTING VIEWERS TO CONSIDER CLOSING A PORTION OF VINE STREET On motion by Mrs. Gleason, seconded by Mr. Barnes, the resolution appointing viewers to consider closing a portion of Vine Street was unanimously approved by Council. WHEREAS, this Council has received a petition from Ralph Cason, Robert Johnson and Ruby Holloway requesting vacation of a portion of Vine Street adjacent to Parcels 61 and 62 on City Tax Map 56; and WHEREAS, it appears to Council that the notice required by Section 15.1-364 of the Code of Virginia (1950), as amended, has been duly advertised; now, therefore, BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that Ms. Mary Jane, Messrs. W. Jo Copeland and Ho P. Winn, Jr. report in writing to Council what inconvenience, if any, would result from such vacation. ORDINANCE: REZONING PROPERTY AT SOUTHWEST CORNER OF 5TH STREET,S.W. AND HARRIS ROAD FROM R-3 TO B-2 (2nd reading) The ordinance entitled "AN ORDINANCE AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, BY THE REZONING OF PROPERTY LOCATED AT THE SOUTHWEST CORNER OF FIFTH STREET, S.W. AND HARRIS ROAD" which was offered at the September 2nd meeting, was approved by the following vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. Gleason, Dr. Hall, Mr. Towe. Noes: None. ORDINANCE: PERMITS FOR PAVING CUTS Mr. Hendrix stated that the ordinance would implement the program which would require permits for pavement cuts, and would require that certain procedures be followed concerning excavation and cleanup and that a bond be required. Mr. Hendrix stated that the ordinance had been discussed with the companies that would be affected. Mr. Hendrix stated that the inspector for the program would be supported by the fees.
