156 <br /> <br /> provided it satisfies certain local needs. <br /> <br />RESOLUTION: APPOINTING VIEWERS TO CONSIDER CLOSING A PORTION OF <br />UNFINISHED HIGH STREET <br /> <br /> On motion by Mr. Barnes, seconded by-Mr. Towe, the <br /> resolution appointing viewers to consider closing a portion <br /> of unfinished High Street was unanimously approved by <br /> Council. <br /> <br /> WHEREAS, this Council has received a petition from Mark <br />and Tina Kavit and Walter and Barbara Pilkey requesting <br />vacation of unfinished High Street adjacent to Parcels 153 <br />and 154, and that portion of an alley off unfinished High <br />Street which adjoins Parcel 153, all on City Real Property <br />Tax Map 33~ and <br /> <br /> WHEREAS, it appears to Council that the notice required <br />by Section 15.1-364 of the Code of Virginia (1950), as <br />amended, has been duly advertised; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesvi!le~ Virginia that Ms. Mary Jane Haynes, Messrs. <br />W. Jo Copeland and H. P. Winn, Jr. report in writing to <br />Council what inconvenience, if any, would result from such <br />vacation. <br /> <br />ORDINANCE: RELATING TO RETIREMENT PLAN (2nd reading) <br /> <br /> Responding to a question from Mr. Towe concerning why <br />the change in the retirement plan was being recommended at <br />this time, Mr. Hendrix stated that the Retirement Commission <br />had recommended the change as a matter of equity. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND <br />REORDAIN SECTIONS 20-12, 20-13, AND 20-18 OF ARTICLE II, AND <br />SECTIONS 20-19, 20-21, 20-22 AND 20-30 OF ARTICLE III OF <br />CHAPTER 20 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, TO INCLUDE CERTAIN PART-TIME EMPLOYEES IN THE <br />RETIREMENT PLAN, TO ELIMINATE AGE 70 AS A MANDATORY <br />RETIREMENT AGE FOR GENERAL EMPLOYEES AND TO MAKE <br />HOUSEKEEPING CHANGES" which was offered at the March 2nd <br />meeting, was approved by the following vote. Ayes: Mr. <br />Barnes, Mr. Buck, Mrs. Gleason, Dr. Hall, Mr. Towe. Noes: <br />None. <br /> <br />ORDINANCE: CLOSING AN ALLEY OFF HARRIS STREET <br /> <br /> Mr. Hendrix stated that neither staff nor the viewers <br />opposed closing the alley off Harris Street. <br /> <br /> Responding to a question from Dr. Hall concerning why <br />the applicant wished to close the alley, Mr. Ralph Main, <br />representing the property owner who had petitioned for the <br />alley closing, stated that acquiring the 7 1/2 feet of land <br />would allow the gas station on the property to expand. <br /> <br /> On motion by Dr. Hall, seconded by Mr. Barnes, the <br /> ordinance entitled "AN ORDINANCE CLOSING, VACATING AND <br /> DISCONTINUING AN ALLEY OFF HARRIS STREET" was offered and <br /> carried over to the next meeting for consideration. <br />ORDINANCE: CLOSING SAXTON STREET <br /> <br /> Mr. Hendrix stated that the viewers reported that they <br />felt some inconvenience would be caused by closing Saxton <br />Street in order to use part of the street for the Vinegar <br />Hill South project. <br /> <br /> Mr. Wiley stated that the viewers are advisory to <br />Council. <br /> <br />Mr. Steve Dupree of 200 South Street Partnership, owner <br /> <br /> <br />
