251 <br /> <br />The public hearing was opened. <br /> <br /> As there was no one to speak, the public hearing was <br />closed. <br /> <br /> The ordinance entitled "AN ORDINANCE TO CHANGE <br />TEMPORARILY THE LOCATION OF THE VOTING PLACE FROM CLARK <br />ELEMENTARY SCHOOL TO BELMONT BAPTIST CHURCH FOR THE CLARK <br />SCHOOL PRECINCT" Which was offered at the July 6th meeting, <br />was approved by the following vote. Ayes: Mr. Barnes, Mr. <br />Buck, Mrs. Gleason, Dr. Hall, Mr. Towe. <br /> <br />ORDINANCE: RELATING TO TERMS OF BOARDS AND COMMISSIONS <br /> <br /> Mr. Hendrix stated that the ordinance had been deferred <br />from the previous meeting so that staff could research the <br />issue further. <br /> <br /> Ms. Jeanne Cox, Clerk of Council, stated that the <br />boards which have two year terms and have representatives <br />from other jurisdictions, do not limit their terms to two <br />complete terms. <br /> <br /> Mr. Buck stated that he would favor allowing persons to <br />serve four complete two-year terms. <br /> <br /> Mrs. Gleason stated that she would be in favor of <br />limiting persons to three complete two-year terms to keep <br />them consistent with other boards. <br /> <br /> On motion by Mr. Towe, seconded by Dr. Hall, the <br />ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />SECTION 2.3 OF THE CODE OF THE CITY OF CHARLOTTESVILLE <br />REGARDING LIMITATION ON TERMS OF MEMBERS OF BOARDS AND <br />COMMISSIONS" was offered and carried over to the next <br />meeting for consideration. <br /> <br />ORDINANCE: BANNING ROOSTERS IN CITY LIMITS <br /> <br /> Mr. Charles Steen of 1412 Baker Street, stated that a <br />neighborwho was unable to attend the meeting had sent a <br />signed objection to the rooster. Mr. Steen played a tape <br />recording of the rooster made at his bedroom window at 4:15 <br />a.m. Mr. Steen thanked City staff for their cooperation. <br /> <br /> Ms. Arlene Rush of 1408 Baker Street, requested that <br />Council approve the ordinance banning roosters in the City <br />limits as she has disabled children who need quiet time. <br /> <br /> Responding to an inquiry from Mr. Buck about whether <br />roosters would be subject to grandfathering, Mr. Wiley stated <br />that he did not believe roosters would be subject to <br />grandfathering. Mr. Wiley stated that he had spoken with <br />the Commonwealth's Attorney about enforcing the noise <br />ordinance with regard to the rooster's crowing. <br /> <br /> Mr. Buck stated that he would not support <br />grandfathering roosters in the City limits, but that <br />would be subject to the courts' interpretation. <br /> <br /> On motion by Dr. Hall, seconded by Mr. Barnes, the <br />ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />SECTION 4-7 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1976, AS AMENDED, TO PROHIBIT THE KEEPING OF ROOSTERS WITHIN <br />THE CITY" was offered and carried over to the next meeting <br />for consideration. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> <br />
