This permit shall not be assigned without the express permission of City <br />Council. <br /> <br />RESOLUTION: APPROVING CAFP~ PERMIT FOR BIZOU RESTAURANT <br /> <br /> Mr. Caravati said he would like to defer approval of the caf6 permit for Bizou <br />since the new drawing was just given to Council. <br /> <br /> Mr. Cox said that if the kiosk was removed, there would be more space for the <br />caf6. <br /> <br /> Ms. Daugherty said she would like to pursue the possibility of removing the kiosk <br />and changing the planters. <br /> <br /> Mr. O'Connell noted that discussions have occurred about removing the kiosks, <br />independent of the caf6 issue. <br /> <br /> Mr. Toscano said that often the businesses adjacent to restaurants are not open <br />when the cafes are and questioned whether consideration should be given to linking the <br />permit to certain times. <br /> <br /> Mr. Higgins said he thinks it would be preferable to have all cafes uniformly <br />open. <br /> <br /> The resolution approving the caf~ permit for Bizou was deferred to the next <br />meeting. <br /> <br />RESOLUTION: APPROVING CAFI~ PERMIT FOR RAPTURE RESTAURANT <br /> <br /> Mr. Higgins said that staff do not recommend approving all three requested <br />locations for the caf6 for Rapture Restaurant, but recommend the one closest to the store <br />and one other. <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Caravati, the caf6 permit for <br />Rapture Restaurant, as recommended by staff, was approved by the following vote. <br />Ayes: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr. Toscano. Noes: None. <br /> <br /> WHEREAS, Rapture, Inc. has applied to City Council for a permit to operate an <br />outdoor caf6 on the pedestrian mall at 303 East Main Street in connection with the <br />operation of its duly licensed restaurant (Rapture Restaurant); and <br /> <br /> WHEREAS, this Council finds that the proposed outdoor caf6 is in keeping with <br />the intent of the pedestrian mall, can add significantly to successful commerce in the <br />downtown area, will not unreasonably restrict the movement of pedestrian traffic and will <br />not endanger the public health, safety or welfare; now, therefore, <br /> <br /> BE IT RESOLVED that Rapture, Inc. is hereby granted a permit to operate an <br />outdoor caf6 on the pedestrian mall at 303 East Main Street subject to the following <br />conditions and terms: <br /> <br /> 1. The permit shall be valid from its adoption (or effective date if different from <br />the date of adoption) until November 30, 2001, for operation of the caf6 during the <br />months of March through November. Not later than November 30 of each year, the <br />operator shall remove from public property all furniture and equipment used for such caf6 <br />operation. <br /> <br /> 2. The caf6 shall be operated only in the designated area shown on the attached <br />sketch. The caf6 shall be in operation only during the hours the restaurant is open. No <br />caf6 furnishings or equipment shall be permitted to obstruct any fire lane. The designated <br /> <br /> <br />
