246 NOTICE OF SPECIAL MEETING A SPECIAL MEETING OF THE COUNCIL WILL BE HELD ON Monday, December 6, I999 AT 6:00 p.m. IN THE Second Floor Conference Room. THE PROPOSED AGENDA tS AS FOLLOWS: Closed meeting as provided by Section 2. !-344(P0 of the Virginia Code BY ORDER OF THE MAYOR BY Jeanne Cox (signed) SECOND FLOOR CONFERENCE ROOM - December 6, 1999 Council met in special session on this date with the following members present: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr. Toscano. On motion by Mr. Caravati, seconded by Ms. Richards, Council voted (Ayes: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr. Toscano. Noes: None.) to meet in a closed session for the purpose of appointing members to various City boards or agencies, as authorized by Section 2.1-344(A)(1) of the Virginia Code; for the purpose of considering the acquisition of real property for public purpose, or the disposition of publicly held property, when discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the City, as authorized by Section 2.1- 344(A)(3) of the Virginia Code, and more specifically described as property near Page Street; for the purpose of consultation with legal counsel and briefings by staff members, consultants or attorneys on a matter pertaining to actual or probable litigation, where such briefing in an open meeting would adversely affect the negotiating or litigating position of the City, as authorized by Section 2.1-344(AX7) of the Virginia Code. The substance of another matter to be discussed can reasonably be identified as follows: changes in certain local government boundaries, and related alternatives. A closed sessionon this subject is authorized by Section 15.2-290709). Council reconvened in open session and, on motion by Ms. Richards, seconded by Mr. Caravati, approved the following certification of closed meeting by the following vote: Ayes: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards, Mr. Toscano. Noes: None. WItEREAS, the City Council has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and WHEREAS, Section 2L344.1 of the Code of Virginia requires a certification by the Council that such closed meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE 1T RESOLVED that the City Council hereby certifies that, to the best of each member's knowledge, (i) only public business matters lawfully exempted fi:om open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Council.
