294 <br /> <br /> Ivlr. Yellott said that the fact that citizens have recourse satisfies his concerns <br />somewhat. Mr. Yellott said that the question still remains that the ordinance may be <br />unconstitutional, but it has never been tested. <br /> <br /> Mr. Richards made a motion to approve the amendments suggested by Mr. <br />Gouldman, Mr. Caravati seconded the motion, and the ordinance was amended by the <br />following vote. Ayes: Mr. Caravati, Mr. Cox, Ms. Daugherty, Ms. Richards. Noes: <br />None. Absent: Mr. Toscano. <br /> <br /> The ordinance entitled "AN OP. D1NANCE AMENDING AND REORDAINYNG <br />SECTIOONS 15-139, 15-140 AND 15-141 OF THE CHARLOTTESVILLE CITY <br />CODE, 1990, AS AMENDED, RELATED TO ENFORCEMENT OF PARKING <br />ORDINANCES," as amended, which was offered at the January 18th meeting, was <br />approved by the following vote. Ayes: Mr. Caravati, Mr. Cox, Ms. Daaagherty, Ms. <br />Richards. Noes: None. Absent: Mr. Toscano. <br /> <br />CONSENT AGENDA <br /> <br /> On motion by Ivlr. Caravati, seconded by Mr. Cox, the following consent agenda <br />items were approved by the following vote. Ayes: Mr. Caravati, Mr. Cox, Ms. <br />Daugherty, Ms. Richards. Noes: None. Absent: Mr. Toscano, <br /> <br />a. Minutes of January 14 and 18 <br /> <br />b. RESOLUTION: <br /> <br />Annual Waiver of Fees and Use of Park by <br />Dogwood Festival <br /> <br /> WltEREAS, the 51st annual Dogwood Festival wilt take place from April 18-30, <br />2000; and <br /> <br /> WHEREAS, it has been requested that Council waive certain license tax and <br />other requirements applicable to the Dogwood Festival, for the duration of the Festival; <br />and <br /> <br /> WItEREAS, City Council is willing to support this request to the extent set forth <br />below; now, therefore, <br /> <br /> BE IT RESOLVED that the following fees and requirements are waived for the <br />Dogwood Festival: <br /> <br />The carnival business license tax imposed by City Code § 14-23(1) <br />($550/day); <br /> <br />2. The tent erection fee imposed by City Code §5-57 ($10); <br /> <br />3. The zoning inspection. <br /> <br />4. Fees for inspection of amusement rides associated with festival. <br /> <br /> BE IT FURTHER RESOLVED by the Council that the following matters, to the <br />extent applicable, are not waived: <br /> <br />1. Peddler's license and fee imposed by CitY Code §14-17(d). <br /> <br />2. Policing deposit for carnival impoSed by City Code §3-2 ($50/day). <br /> <br />'Vendor regulations in accordance -with City Code §28-11 I, et seq., <br />provided, however, that vendors shall be allowed to operate until 11:00 <br />p.m. for the duration of the festival. <br /> <br />Liability insurance in the amount of at least $1,000,000 with certificate of <br />insurance naming City as an additional insured. <br /> <br /> <br />
