APPROPRIATION: <br /> <br />Approving Computer Aided Dispatch Agreement <br />and Re-appropriating Capital Funds (carried over) <br /> <br />d. RESOLUTION: <br /> <br />Authorizing Withdrawal from Shenandoah Juvenile <br />Detention Center <br /> <br /> WHEREAS, the City of Charlottesville ("City") is a member jurisdiction in the <br />Blue Ridge Juvenile Detention Commission (hereafter Blue Ridge); and <br /> <br /> WHEREAS, Blue Ridge is constructing a juvenile detention facility in Albemarle <br />County which will he available for occupancy prior to July 1, 2002; and <br /> <br /> WHEREAS, it is now timely for the City to withdraw as a member from the <br />Shenandoah Valley Juvenile Detention Center Commission (hereafter Shenandoah); and <br /> <br /> WHEREAS, it is necessary for the City to enter into an agreement with <br />Shenandoah to continue to use its facility until such time as the Blue Ridge facility is <br />available for use. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Charlottesville, Virginia hereby gives notice that the City requests to withdraw from the <br />Shenandoah Valley Juvenile Detention Center Commission effective April 1, 2000. <br /> <br /> BE IT FURTHER RESOLVED, that the City Manager is authorized to execute <br />the attached Agreement establishing the terms and conditions for the City to continue to <br />use the Shenandoah Juvenile Detention Center until the Blue Ridge Juvenile Detention <br />facility is available and establishing the terms, conditions and amount of the withdrawal <br />payment from the Shenandoah Detention Center Commission to be paid to the City upon <br />the April 1, 2000 withdrawal. <br /> <br />e. RESOLWI~IONS: <br /> <br />Approving Caf6 Permits for 1) Downtown Grill and <br />2) Le Bon Ton <br /> <br /> WHEREAS, The Downtown Grille, LLC has applied to City Council for a permit <br />to operate an outdoor caf6 on the pedestrian mall at 201 West Main Street in connection <br />with the operation of his duly licensed restaurant (Downtown Grille); and <br /> <br /> WHEREAS, this Council finds that the proposed outdoor caf6 is in keeping with <br />the intent of the pedestrian mall, can add significantly to successful commerce in the <br />downtown area, will not unreasonably restrict the movement of pedestrian traffic and will <br />not endanger the public health, safety or welfare; now, therefore, <br /> <br /> BE IT RESOLVED that Downtown Grille, LLCis hereby granted a permit to <br />operate an outdoor caf6 on the pedestrian mall at 20t West Main Street~ subject to the <br />following conditions and terms: <br /> <br /> 1. The permit shall be valid from its adoption (or effective date if different from <br />the date of adoption') until November 30, 2001, for operation of the caf6 during the <br />months of March through November. Not later than November 30 of each year, the <br />operator shall remove from public property alt furniture and equipment used for such caf6 <br />operation. <br /> <br /> 2. The caf6 shall be operated only in the designated area shovra on the attached <br />sketch. The caf6 shall be in operation only during the hours the restaurant is open. No <br />caf6 furnishings or equipment shall be permitted to obstruct any fire lane. The designated <br />area of operation shall be clearly delineated by the use of a combination of trees, fences, <br />planters and barriers. <br /> <br /> <br />
