146 <br /> <br /> Mr. Toscano said he does not understand why anyone would not want to have the <br />answers to these questions, noting that he thinks the public would like to know the <br />answers. <br /> <br /> Mr. Caravati said the information will be very helpful to Council as they hear the <br />appeal. <br /> <br />Mr. Lynch expressed concern that the role of the BAR is being usurped. <br /> <br /> Mr. Gouldman noted that the BAR made the request of Council, and the idea is <br />that the consultant will act prior to the BAR's deadline so they can take that information <br />into consideration. Mr. Gouldman said he does not think this takes over the BAR's rote. <br /> <br />Mr. Toscano made a motion to approve the charge. <br /> <br /> Ms. Richards said she wishes she had more information on whether this is <br />consistent with the BAR's charge, <br /> <br /> Mr. Caravati seconded the motion, noting that questions one and two were asked <br />by the BAR repeatedly and they were not answered to their satisfaction. <br /> <br /> Ms. Richards agreed that the BAR and Council need as much professionally <br />gathered information as possible. <br /> <br /> Mr. Lynch asked who will select the architectural firm, and Mr. Gouldman said <br />that Mr. Jim Tolbert and D & R Development will choose the firm. Mr. Gouldman noted <br />that Mr. Schwartz provided names for firms to be considered. <br /> <br />Ayes: <br />Cox. <br /> <br />The charge as presented by Mr. Gouldman was approved by the following vote. <br />Mr. Caravati, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. <br /> <br /> Mr. Toscano made a motion to authorize the City Manager to hire the <br />architectural firm, to be paid on a 50/50 basis with the developer. Ms. Richards seconded <br />the motion. <br /> <br /> Concern was expressed about the amount authorized, and Mr. Toscano withdrew <br />his motion. <br /> <br /> Mr. Toscano made a motion to authorize the City Manager to hire an architectural <br />firm on the condition that D & R share in the cost and the City's share is no more than <br />$5,000. <br /> <br />Ms. Richards said that an equal share needs to be maintained. <br /> <br /> Mr. Gouldman recommended that the City's share be increased to $7,500, to be <br />shared on an equal basis with the developer, and Mr. Toscano and Ms. Richards accepted <br />that amendment to their motion. <br /> <br /> Council authorized the City Manager to hire an architectural firm, on the <br />condition that the City's share be no more than $7,500 and that the cost be shared equally <br />between the City and the developer, by the following vote. Ayes: Mr. Caravati, Mr. <br />Lynch, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Richards, Council voted (Ayes: Mr. <br />Caravati, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. Absent: Mr. Cox) to <br />meet in closed session for the purpose of appointing members to various City boards or <br />agencies, as authorized by Section 2.1-344(A)(1) of the Virginia Code, for the purpose of <br />considering the acquisition of real property for public purpose, or the disposition of <br />publicly held property, when discussion in an open meeting would adversely affect the <br />bargaining position or negotiating strategy of the City, as authorized by Section 2.1- <br />344(A)(3) of the Virginia Code, and more specifically described as property on Ridge- <br /> <br /> <br />
