193 <br /> <br /> Ms. Kelley said that Alexandria's ordinance includes both restrictions. <br /> <br /> Ms. Richards asked which restriction is better, and Ms. Kelley said that the courts <br />seem more comfortable with the decibel level, Ms. Kelley noted that witnesses are <br />needed when a public nuisance is found. <br /> <br /> Mr. Lynch said that the decibel level restriction would require that the police <br />carry the machine around or they would have to go and get it. <br /> <br /> Ms. Richards said it is a very arduous process. <br /> <br /> Mr. Cox said that only two officers would be involved and he thinks they could be <br />trained. <br /> <br />Ms. Kelley said she would like to talk to the police about their preferences. <br /> <br />Ms. Richards said she likes the approach of either or. <br /> <br /> Mr. Lynch suggested running the proposed ordinance by the Downtown Property <br />Owners group and Charlottesville Downtown Foundation. Mr. Lynch said he would like <br />to see a provision for special permission for variances, <br /> <br /> Mr. Cox said he is interested in seeing a sample ordinance and testing done <br />regarding decibel levels so Council can evaluate if they want to enact it. Mr. Cox said it <br />is clearly needed as musicians have not been willing to change. <br /> <br />Mr. Lynch said he has heard it has gotten quiet in the last couple weeks. <br /> <br />Mr. Cox said he thinks a reasonable standard needs to be established. <br /> <br /> Ms. Richards said she thinks an ordinance is needed as music on the mall should <br />be for people who wish to listen to it. Ms. Richards said she has received complaints also <br />about the noise level ofthe City's leaf blower. Ms. Richards said she would like to see <br />the ordinance be specific to electronieally amplified music only, with hours addressed, <br />and special events exempted. <br /> <br /> Mr. Caravati noted that drums would not be included in Ms. Richards's <br />suggestions. Mr. Caravati said he thinks it is a shame that the City has to regulate the <br />noise, but he sees no other way for everyone to enjoy the mail Mx. Caravati said the City <br />could considering looking at licensing musicians, but he is not recommending that now. <br /> <br />REPORT: BIENNIAL BUDGET <br /> <br /> Mr. Chris C~linan, Budget Director, said he has been researching switching to a <br />two-year budget process which could assist in long-term planning and implementation of <br />current studies. A budget would be adopted in the first year, and minor adjustments only <br />would be made in the second year. Council would still be required to hold public <br />hearings every year and adopt an annual appropriation~ Mr. Cullinan said staff <br />recommends adopting the biennial budget, but not until next year to have it mirror the <br />state's budget as that budget impacts the City's. <br /> <br /> Mr. Cox asked if there would be complications if the County did not have a <br />biennial budget, and Mr. Cullinan said that would be one of the challenges, as would <br />agencies and schools. <br /> <br />Mr. Caravati said it worries him how difficult it would be every two years. <br /> <br /> Ms. Richards said it can also get politically crazy as it does at the state level. Ms. <br />Richards said she is a little ambivalent about it, though she thinks it does have a <br />stabilizing effect. <br /> <br /> Mr. Cox said he is interested in being able to focus on conceptual priorities or <br />benchmarking. <br /> <br /> <br />
