2O9 closed session for the purlx>se of appointing members to various City boards or' agencies,, as authorized by Section 2. t-344(A)(1) of the Virginia Code; and 2) for the purpose of considering the acquisition of real property for public purpose, or the disposition of publicly held property, when discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the City, as authorizxxt by Section 2.1- 344(A)(3) of the Virginia Code, and more specifically described as property near Rio Road and property on Douglas Avenue. Council reconvened in open session and, on motion by Mr. Lynch, seconded by Mr. Cox, approved the following certification of closed meeting by the following vote WHEREAS, the City Council has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and WHEREAS, Section 21.344.1 of the Code of Virginia requires a certification by the Council that such closed meeting was conducted in conformity- with Virginia law; NO'W, THF~REFORE, BE IT RESOLVED that the City Council hereby certifies that, to the best of each memher~s knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the closed meetLug were heard, discussed or considered by the Council. APPOINTMENTS: BOARDS AND COMMISSIONS On motion by Mr. Toscano, Ms. Ava Baum was appointed to an unexpired term on the Personnel Appeals Board by the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms, Richards, Mr. Toscano. Noes: None. This term will expire on December 31, 2001. Mr. Caravati asked ~f Councilors have any changes to the position regarding parkland. Ms. Richards reminded Council that the General Assembly approved a bill which enables the Virginia Department of Transportation (VDOT) to use funds for land acqui~tion, though it is axnbiguous as to how much land replacement is covered by the bill. Ms. Richards noted that VDOT cannot exercise imminent domain to acquire property under this bill.
