35 <br /> <br /> On motion by Mr. Barnes, seconded by Mrs. Gleason, the <br />$1,212 appropriation for the Virginia Municipal League to <br />participate in a telephone rate case was offered and carried <br />over to the next meeting for consideration. <br /> <br />RESOLUTION: GRANTING SPECIAL PERMIT TO COVENANT SCHOOL FOR <br />USE OF McINTIRE SCHOOL BUILDING <br /> <br /> Mr. Huja gave the Planning Commission's reasons for <br />recommending approval of the special permit for the Covenant <br />School: 1) It will not have a significant adverse impact on <br />the surrounding neighborhood, 2) The proposal does not signi- <br />ficantly alter the intended use of this facility, and 3) The <br />proposal is temporary in nature and can comply with applicable <br />codes regarding on-site parking accommodations. Mr. Huja added <br />that Planning Commission approval was conditional upon the <br />following: 1) That the special permit be granted for a one year <br />period only, 2) That the use be limited to the areas shown on <br />the attachments and that any expansion of the use required an <br />amendment to the special permit, 3) That adequate fenced playground <br />facilities be added for the use of the school children, 4) That <br />proper marking of the parking lot be accomplished to current city <br />code standards as an amendment to the site plan, and 5) That any <br />future requests for extension of this special permit involve the <br />permanent prohibition of left turns into and out of this neighbor- <br />hood from the Bypass and that necessary alternate measures be <br />provided then. In the meantime, the hours for prohibition of <br />left turns should be expanded upon recommendations of the Traffic <br />Engineer. <br /> <br /> Mrs. Gleason pointed out that Mr. Stephen Yowell, Headmaster <br />for the Covenant School, had stated that he would recommend that <br />left turns not be made into the school from the Bypass. <br /> <br /> Responding to a question~ by Mr. Barnes, Mr. Yowell stated <br />that kindergarten children would be picked up at 12:30 p.m. and <br />others at 3:00 p.m. to 3:30 p.m. <br /> <br /> Mr. Barnes recommended notifyng the Traffic Engineer of the <br />pick-up times in case he felt left turns should be prohibited <br />during those times. <br /> <br /> Mr. Buck recommended eliminating condition ~5 above, as <br />recommended by the Planning nCommission out of fairness to the <br />residents and recommended that the area be studied by the staff. <br /> <br /> On motion by Mrs. Gleason, seconded by Mr. Barnes, the <br />resolution granting a special permit to the Covenant School <br />for the temporary use of the McIntire School building, with the <br />elimination of condition 95 above, was unanimously approved by <br />Council. <br /> <br /> Mr. Barnes stressed that the Traffic Engineer should study <br />the area as soon as possible. <br /> <br />ORDINANCE: VENDOR POLICY ON CITY STREETS AND SIDWALKS <br /> <br /> Mr. Roger Wiley, City Attorney, stated that an ordinance <br />had been drafted to govern all street vendor sales in the City. <br />Mr. Wiley sum~,arized the ordinance and a map was displaying <br />showing 16 locations which had been identified as potential <br />vendor locations on the downtown mall. <br /> <br /> Before allowing public comment, Mr. Buck stated that he <br />felt it was the feeling of the Council to limit the number of <br />vendors on the downtown mall to a smaller number, approximately <br />seven, in order to preserve freedom of movement and visual <br />appearance. Mr. Buck stressed that he felt the ordinance should <br />be viewed as a working document which could be modified before <br />the final adoption. <br /> <br /> <br />
