36 <br /> <br /> Mr. John Carter, owner of Artists Portfolio, stated <br />his disappointment that merchants had not had input in <br />writing the ordinance. <br /> <br /> Mr. Charles Kabbash, 414 E. Market Street, recommended <br />that opinions be given at an informal meeting rather than <br />during the regular Council meeting. <br /> <br /> Mr. Buck recommended that a meeting be held at 2:00 <br />p.m. on Friday, May 24th in order to discuss the ordinance, <br />but requested that persons continue to give their recommenda- <br />tions at the present meeting. <br /> <br /> Mr. Marshall Pryor of the Young Men's Shop, stated that <br />he felt the fees required in the ordinance were too low, <br />especially for short-term permit holders. <br /> <br /> Mrs. Florence Skove of Logos, objected to the $50 fee <br />required for existing businesses to place carts outside their <br />stores. <br /> <br /> Mr. Wiley stated that the fees were related to the <br />costs involved in administering the permits. <br /> <br /> Mr. George Wiltshire of the Pewter Corner, opposed the <br />fee charged to existing businesses to put a cart outside <br />their stores. <br /> <br /> Ms. Paty Kulman of Patty's Popcorn Parade, requested <br />clarification of the ordinance and stated that she would <br />withold her comments until the informal meeting. <br /> <br /> Mr. Robert Nelson, a vendor on the downtown mall, spoke <br />in general agreement with the ordinance. <br /> <br /> Mr. Fred Schmidt of Schmidt's Toy Store, requested <br />clarification of the ordinance and asked if research had <br />been conducted regarding how other cities deal with the <br />issue. <br /> <br /> Mr. Wiley stated that research had been done and that <br />the approaches taken by cities had been diverse and that <br />while some points in the ordinance had been ideas used by <br />other cities, no ideal model had been found. <br /> <br /> Mr. Tom Fitch, Director of Towntown Charlottesville, <br />Inc., stated that DCI would be interested in attending the <br />informal meeting and making recommendations at that time. <br /> <br /> Mr. Wiltshire suggested that waivers for special <br />events be made easy to acquire and asked what penalty would <br />result if the ordinance was violated. <br /> <br /> Mr. Wiley replied that violation of the proposed <br />ordinance would be a Class III misdemeanor. <br /> <br />The public hearing was closed. <br /> <br /> Mr. Barnes stated that he felt the ordinance was a <br />good beginning but had concerns that the number of vendors <br />allowed was too high and that the fees for annual permit <br />holders seemed too low. Mr. Barnes added that he felt it <br />was important that the mall merchants be involved in the <br />review procedure. <br /> <br /> Mrs. Gleason concurred with Mr. Barnes' comments and <br />added that she had some reservations with the first-come, <br />first served concept. <br /> <br /> Mr. Buck stated that he felt that in addition to the <br />overall number of vendors being too high, that the three <br />locations for nono-profit organizations were too high and <br />that they should be regulated in terms of duration, that <br /> <br /> <br />
