111 <br /> <br />RESOLUTION: AUTHORIZING PERMIT FOR OUTDOOR CAFE FOR ZONA ROSA 0N <br />DOWNTOWN'MALL <br /> <br /> Mr. Hendrix stated that an application had been recsived <br />for an outdoor cafe on the Central Place and the permit was in <br />line with the other outdoor cafe permits on the downtown mall. <br /> <br /> Mr. David Damewood, owner of the Zona Rosa Restaurant, <br />stated that Mr. Craig Redinger of the Central Place Ltd. <br />Partnership, had requested that the permit be taken out by <br />the Partnership. <br /> <br /> Mr. Buck informed Mr. Damewood that the permit could only <br />be given to the restaurant operator and was not transferable. <br /> <br /> Mr. James McCue, architect for Zona Rosa, presented the <br />plans for the cafe. <br /> <br /> Mr. BUck noted concern that the waitress station might <br />block the view of other stores. <br /> <br /> Mr. McCue responded that Zona Rosa was expanding into <br />a portion of the space next to the restaurant and he felt <br />the blockage would be minimal. <br /> <br /> Mr. Hendrix stated that the City would not permit <br />bollards to be attached to the mall. <br /> <br /> Mr. Buck stated that Council is in the process of <br />considering charging rent for use of the space for the outdoor <br />cafes. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Gunter, the <br />permit for an outdoor cafe for Zona Rosa was unanimously <br />approved by Council. <br /> <br /> WHEREAS, Daviela, Inc. has applied to City Council for <br />a permit to operate an outdoor cafe on the pedestrian mall in <br />the 200 block of East Main Street, in connection with the <br />operation of its duly .licensed restaurant at the Central Place; <br />and <br /> <br /> WHEREAS, this Council finds that the proposed outdoor <br />cafe is in keeping with the intent of the pedestrian mall, <br />can add significantly to successful commerce in the downtown <br />area, will not unreasonably restrict the movement of pedestrian <br />traffic and will not endanger the public health, safety or <br />welfare; now, <br /> <br /> BE IT RESOLVED that Daviela, Inc. is hereby granted a <br />permit to operate an outdoor cafe on the pedestrian mall <br />in the 200 block of East Main Street, subject to the following <br />conditions and terms: <br /> <br /> 1. The permit shall be valid from its adoption until <br />November 30, 1986, for operation of the cafe during the months <br />of March through November. Not later than No.vember 30 of <br />each year, the operator shall remove from public property all <br />furniture and equipment used for such cafe operation. <br /> <br /> 2. The cafe .shall be operated only in the areas designated <br />on the attached drawing dated August 14, 1985 prepared by <br />James R. McCue, Architect, and incorporated by reference in this <br />resolution. No cafe furnishings or equipment shall be <br />permitted to obstruct any fire lane. The designated area of <br />operation shall be clearly delineated by the use of a combination <br />of chains, planters and barriers of a design to be finally <br />approved by the City Manager. <br /> <br /> 3. The Downtown Board of Architectural Review shall <br />approve final designs for the care furniture, awnings or canopies <br />and other fixtures or equipment to be used for operation of the <br />cafe, and the City Manager shall approve the method, if any, by <br />which such items will be anchored, to prevent permanent damage <br />to the mall surface. <br /> <br /> <br />
